Question For The Legal Eagles and HR Folks
Are employers required to offer holidays to their employees? Are there certain holidays which MUST be given to all employees? Are employers bound legally to offer a certain amount of vacation or sick time to their employees?
What I am driving at is - could an employee decide that his business has grown and that he no longer will be offering the few days he currently gives his employees as holidays?
I am specifically interested in laws as they apply to NY Corporations.
Long story short - I got in an argument with my boss who told me that holidays - Thanksgiving, Christmas, etc.. are not entitlements and that if he decides to retract those days as paid holidays there isn't a damn thing anyone can do about it.
I am afraid he may be right!

He might be right.
I had to use personal days for my religious observances when I worked in a corporate field. Granted, the rest of the world did not shut down for my holidays, but still, I was not entitled to those days despite the fact they were extremely holy.

It would depend on a few things.
Off the top of my head & rushed for time:
If you're covered under a collective bargaining agreement, then no.
Otherwise if he issued an employee handbook indicating that holidays would be paid, he would need to issue an update to the handbook.
Employers are not required to pay you for holidays. However, he can't penalize you (ie fire you) for taking off a religious holiday. Also depending on your situation (salaried position), that could change.

But did you get OTHER holidays? He is saying NO HOLIDAY is entitled. Nothing. They are all given under his good grace.

We aren't a union and we have no collective bargaining agreement. We don't have an employee handbook, but I do have the agreed upon days in my employment contract. Of course the contract is renewable each time I get a review - he has taken days away in the past. We went from 8 to 7 to 5 paid holidays. But has increased my salary and vaca time with each minus. Now he is saying he can take away all vacay and holiday time plus personal days and sick time if he deems it appropriate for his growing business.
I am salaried.

I did get the other holidays off, but they were national holidays or holidays I wouldnt observe and have no meaning to me.
It seems to me that it would be a waste of time and energy for a business to stay open if the postal service and possibly the Stock Exchange is closed for those same days. That could really keep a business from running efficiently on any given day. Trust me, I am not saying he is right - morally he isn't. Legally he might be. But I am not an attorney - I could be wrong.
