Question For HR People
A friend of my sister's just lost her job with a major LI company. This was a six figure position (low 100's) and up until now all of her reviews have been good.
They walked her out last week, gave her 12 weeks severance and wouldn't tell her why they were firing her. They did tell her that if any potential employers were to check her references in the next 12 weeks, they would say she was currently employed. She called me tonight to help her find a lawyer to pursue any possible options she may have. I gave her a few names, but as she didn't have an employment contract, I'm sure her options are very limited at best.
Now maybe I don't have the whole story, but she swears she has no idea what happened or what she may have done. My question is how common is it to be fired without any paper trail at all?? Any thoughts on what may have gone on???

Honestly, no company has to give you a reason why they are letting you go....its called employment at will...and unless she was in a union...I dont think she has a case...unless she can prove that it was due to her age, sex or background
She got a severence package so maybe it was a layoff...

Are you sure she was fired and not laid off?
I am not in HR, but if she got a severance, it sounds like she could have been laid off. Also, the company may be going into Chapter 11 but haven't announced it yet. Is she the only one? Or did others get let go as well?

No I understand that we are an employment at will state, I guess I'm just surprised that there was no paper trail. She was a fairly high paid employee, they spent a lot of money training her over the past few years, and I just found the situation odd. She really strikes me as completely shocked about the whole thing. Also it wasn't a layoff as she was the only one fired and her division is thriving and apparently still adding staff.

I was laid off from a very large investment company...just because they had to do cuts....no other reason..,..
Im sure that there is a letter attached to her severence that in order for her to get the $$ she can not sue them....

I asked that question, but she hasn't seen the actual package yet, nor has she signed anything. Again, she a friend of my sister's and I only know what she told me. So who knows.

Since NY is an at will state the company does not have to give her a reason.
As for severence, I know at my other company they fired numerous people and only 2 high positioned people that were let go were provided with severence. Plus when my old company layed people off none of them got severence. So receiving severence does not necessarily mean a lay off.
When she was fired she should have been provided a letter from HR expaining the reason for her firing, information about Cobra and any other pertanent information about her departure.
Their sounds like their are some things missing in the puzzle. What did HR tell her? Did they say ok well this is not working out so you're gone and here's 12 weeks severence? You are not the one for this job so here's a severence package have a nice life?
I dont think they called her in and said ok well effective tomorrow you really dont work here anymore and here's 12 weeks pay. Now go pack up your stuff and this security guy will walk you out.
Their had to be something that was either said or written to her

This would make sense. In my 8 years at this company, employees usually see the writing on the wall.
If there was a security breach, I'm surprised they gave her severance.
