Hmmm. How frustrating. I'd definitely tell them your offer will be decreased by the amount of a new refrigerator, as that wasn't factored into your initial offer.
How much leverage do you have? Did they have multiple offers? I would push back on the later closing date, especially in this market where they are lucky to have a buyer for their home!
we don't have that much leaverage at this point. but our lawyer is going to tell them no to everything. we were the ONLY bid in the 6mths that the house was on the market.. and the seller is being a hardazz! oh and we can't decrease on our initial offer but it was a good thought/idea.

If you were the only bid on the house, you have all the power.
That's not always true. The first house we bid on had been on the market twice, and when put the bid in, we were the only offer they received in 10 months (and we bought at the height of the market 2 years ago). There was lots of stuff going on back and forth and we also thought we had leverage because we were the only offer, but in the end, the deal fell through.
Anyway, to the OP, I hope this all works out for you.
hey everyone.. again thanks for all of the advice.. I really appreciate it.
so yesterday we went back to the house and spoke with the seller.. and we agreed on a few things: 1) he will leave us 2 fridges and 2)we will close on 9/20 instead of 9/14.
Ok so I felt sooooo gulity I thought that the sellers were 50-65ish.. well their 80ish! and I don't want to push them out.. we already have a place to stay (our current apt). as long as we can move in by 10/1 then we're good.
In NJ the laws are a bit different. The fridge is a personal item of the sellers and the seller can choose to take it or leave it. I was wrong.. it was not on the mls description that the appliances stays. And even if he took the fridge.. we can not decrease the offer for the price of the fridge. it's a different story if he took the stove. When we have the inspection, and if they find something wrong that worth $750 and beyond in damages and the seller refuses to fix it prior to the closing.. then we can back out of the deal without recourse. the sellers have to vacate the property the day of the closing. it's not like ny where they would have 30 days to leave.

I think you handled this situation well.
I would feel bad "pushing" them out also.
It doesn't seem that anyone has been majorly inconvenienced and compromises were made on both parts!
You can all sleep well. These things can get WAY out of hand.
