What would you do in this situation? (VERY LONG)

I know this isn't pregnancy related, although the flooding has brought on contractions when I've tried to move stuff. The stress is getting so bad and I figure you ladies know me best. So I need advice.

When we first moved into our apt our landlord said he'd like us to split the cable bill. No problem. We asked how much it was and he said he'd get back to us. We asked for a couple of months how much we owed. He kept saying he'd check the bill and tell us. They changed to direct TV a year later and said they'd like to split the bill. We said let us know. They never did.

Fast forward to a few months ago. We start having toilet problems. He just kept asking if we dropped something in the toilet. Things got worse. In the past few months our apt has flooded 3 times and he seems indifferent to it. Two nights in the past month the toilet hasn't worked at all. He said he'd look into it in the morning. That's 2 ENTIRE NIGHTS WITHOUT A WORKING TOILET!!!!!! Not so easy when you're this pregnant. We are about to close on our new home and we're trying to put this all behind us.

Mike just went to pay the rent and the landlord tells us the cess poll guy is coming. We begged him for this because our toilet AND shower just overflowed with sh** on Sunday!!! We overheard the cess pool guy say that it's completely up to the grass and needs to be flushed immediately. The landlord blamed us for having people over that day and that the toilet was being used too much. The cess pool guy said it's been years, not a day. Mike began to argue, politely, with the landlord that this has been happening for months and he hasn't done anything. (Well, they were nice enough to help us throw out furniture and items ruined in the flood Chat Icon )

Now the landlord brings up AGAIN that he wants us to help split the cable bill. FINE!! Tell us how much it is. He then states he'll look over the bills from the time we moved in and add it up!!!! Chat Icon Chat Icon Chat Icon That's 2 years of bills!!!!!!! We don't have a lease and we figure our security deposit just about covers 2 years of cable bills. We planned on getting our deposit back!!! The second bedroom is completely moldy, the walls and ceiling have mold creeping out of them, we have thrown out a bunch of things and been without a toilet!!! Do we have any rights?!?!?!?!? Chat Icon Chat Icon Chat Icon Chat Icon Mike said if he brings up the bill again, to try to agree to pay half. We really need our deposit back to help us move out, pay for the baby, and buy new furniture. Am I just hormonal or does this all seem wrong?!?!?!? Thanks for reading this!!!!!

hmm...not having a lease could be a good thing and a bad thing. technically it is not in writing that you would split the cable, so you might be able to get away with it...but it may be hard to get the deposit back from him

MAybe just hold back the last month's rent? Will that cover the security deposit?

I wouldn't give him anything. Your furniture was ruined because of this and it is unacceptable to go 2 nights without a working toilet.

Since you don't have a lease, this is what I'd do as well. Hopefully, you only paid a month's rent.

It isn't right, but it is commonplace to do this, especially when you don't have a lease.

Does he show you escrow accounts where your deposit has been? If not, then you really do not have to pay that last month's rent, I don't think.

First of all, I'm SO sorry. I don't know what I would do besides go crazy....I would most likely hold back the last month's rent. That's completely unfair that he wants to add up all the payments from 2 years Chat Icon Good luck Chat Icon

First of all it is his responsibility to take care of his house and the apartment that he rents. you can live in an apartment for six months without paying your rent before he can do anything to u. SO if he continues with the cable bill. etc. I would give him the rent at all... What an A*** especially since yuo are pregnant !!!!!!!!!!!!!!!

oh Kelly, it is up to the landlord to pay for the cesspool #1 , #2 it is fine to split the cable we did with our prior landlords b4 we moved into an aprt complex.

Your husband needs to take care of it so you do not stress. It sounds like he is so thats a good thing,

As for clogging a cesspool, in our old aprt sh&& filled the tub also and it was not clogged with anythign. The landlord needs to take care of that themselves. It clogs over years of sh%t going in it. therefore it is the landlords priority. Do you have a contract with them? If so make michael bring it to them where it states everything.. if not he can always bring that up to them.

There is also a website, i dont know off hand about renting.. try and do a search.

Ummm, no! The moment the rent is a day late all the landlord has to do is make a demand, wait three days and then haul your arse into court to get you evicted.

With an illegal apartment? Anyway my bigest issue here is with the mold. First, it is NOT good for you to be breathing that in and second the landlord must keep everything in habitable living conditions. I wouild whip out my digital camera and start recording everything and withold rent in case he decides not to give you security.

me too! i'd hold the last month's rent until everything is squared away - don't let yourself be taken advantage of. They're prob bitter that you're a good tenant and moving. Chat Icon Chat Icon Chat Icon

We are past holding back on giving the last month's rent. Our last month here will be August (although we should have our new place before that) and they already have our last months' rent because we gave that when we moved in.

We are just waiting, impatiently, for the call that says when our close date is.
