Is this right?

This is what my gf told me at work this morning.
Her aunt started her job a year ago. She was layed off for a week 6 months ago. Now her bosses are saying that her "start" date is 6 months ago, not a year ago.
Is this right? She can not get vacation time now for another 6 months!

Re: Is this right?

It's crappy but I don't think it's illegal or a violation.

Yes-that makes sense, unless they had an agreement when they re-hired her.

I have heard of companies doing this to get out of paying for benefits, they fire people and then hire them again right away.

That really sux!! She is not getting benefits though and does get paid for all holidays and any days that the bosses take off or let her go home early.

I think because she said they are such a small company.

Re: Is this right?

It's legal, if she was terminated from employment, then rehired, they are using her rehire date as her service date. Is it right or ethical? Not really...seems crappy to me but I guess that's their policy.
