what would you do? contract related
so one of the issues that came up with the home inspection report was that the cesspool was full and needed to be serviced.
our agent got in touch with the seller's agent, who said that they didn't think it was full because the woman who owns the house is in assisted living and hasn't been there for 2 years.
they suspected that it was a clog, not a full cesspool, and sent someone to service it. they (claim to) have a letter stating that the issue was a clog and it has been fixed.
i told the agent to forward the letter to our attorney, who has the contract.
there are a couple of other minor issues that will be addressed in the contract but nothing big like this.
should i insist that the cesspool servicing still be in the contract? i know if i want that i will have to bring someone there myself and pay for them to do a cesspool inspection.
or do i just accept that it was a clog and move on?

Is there a guarantee? Like a 1-year guarantee it won't happen? I don't know anything about cesspools, but for our house, we got the pool liner company to guarantee the liner for a couple fo years.

nope, no guarantee. just a letter that he looked at it and cleared out the clog.
i just don't want it to become a serious problem, but i also don't want to spend an arm and a leg getting someone to go out there and look at it again before we go to contract.

We had a similar situation...we're the buyers and we wanted the cesspool to be treated. But we actually were there (with the homeowners) when they had it done.
IMO I think that if they have a letter and a receipt showing what was done and what company did it, you should use that. Then at least if god forbid anything goes wrong, it's on the cesspool company's hands to take care of b/c they supposedly fixed the problem.

If there was a clog and they cleared it then they did their job. If there is a kink in the line that is causing it to clog then you are screwed. The company was hired to clear the clog not fix the line.
I would have the unit inspected. It may cost you money but it will be cheaper then replacing the septic system. Replacing it is expensive and you don't want a faulty system. I would rather the seller have to rip up everything and replace it then you a month after you move in and the waste starts backing up into your home.
