What do i do? Verizon's Warranty issue
I paid for an upgrade October 5th for a brand new Blackberry Bold and after 5 weeks it started having hardware failures and wouldn't contantly shut down so i went to the store and they said they could warranty it and send me a new Blackberry...well the one they sent me is worse than they way mine was...contantly locks up, numerous times a day it has some issue where i can scroll to anything but cannot open anything no matter how much i click on it and it has application execution errors all the time so i can't open most of my applications...i have to restart it 4-5 times a day. I called the store and they told me mine original phone was replaced with a reufrbished like-new phone, i am about this...i paid for a brand new upgrade 2 months ago and now i have a pre-owned phone full of someone's else's issues. I thought i was getting a "new" blackberry like the guy told me...phone customer service told me if i warranty it again i will just get another pre-owned phone....i don't think that is right...what should i do? Fight it or just accept it? Im mad that i paid for my upgrade for a brand new Blackberry and now i have a pre-owned phone.....

With a warranty its ALWAYS a refurbished phone. Call them back again and tell them there are more issues they will send you another refurbished one... I believe if after that if you still have problems they will give you a brand new one...

i had this problem once and created a scene in the store saying it had been replaced with multiple refurbished phones already and they had issues of their own so i demanded a new one. i got it

I would just go to the store and don't walk out until you have a new phone in your hand, not refurbished. Just remember to be nice to the person behind the counter. They don't make the policies, but they have to follow them. I know you're angry about it but being nice will get you further.

going to the store will not help
you need to call 611 and request a new phone
I just got a "like new phone" last week and they told me if I start having the same issues they would replace it with a new phone

Honestly, all cell phone companies have the same policy. When a phone is replaced for manufacturer issues, it will always be replaced with a refurbished phone.
Personally, I work for a cell phone company and I would not have any issues getting a refurbished phone. They actually go through testing. I'm sory that your replacement phone is not working properly. THey should replace it for you with no questions asked.
Just like new phones go defective, some replacement phones go defective also. It's technology and it happens. As long as the company stands by the product and replaces it for you, I wouldn't be so concerned about the fact that it is refurbished.

Sort of a different situation, but when I was with T-Mobile I had a phone that I could not use without the data plan which they neglected to tell me(or advertise when they showed the phone on the website.) I was having problems with it erasing my contacts etc. When I finally got around to calling them it was after 30 days and they said there was nothing they could do. So I threatened to call the authority in their state to address the issue. They immediately switched me to the "customer retention" department. I got a brand new phone of my choice and to keep the other one.

See, now that to me is not acceptable. If he has been having issues with the same phone to the point where it has to be replaced 8 times, at that point the company should say "enough is enough" and give him a brand new phone. There are exceptions to the rule.
To those who think OP should make a big scene in the store or call corporate, just remember that there are rules in place to keep costs down for customers. If every single customer complained and made a huge stink because their phones were replaced with refurbished devices, other things may start to cost more because the company would have to pay more to replace devices with new phones.
I'm pretty sure nobody wants to see the cost of their monthly service plans going up, or having to pay more to buy a new phone when it is time to upgrade. These are the things that nobody thinks about.
Refurbished phones are not "bad" phones. They are not "dirty" phones. They do not take a phone out of one customer's hand and put it into yours. They are just rebuilt with working parts from phones that are returned and given new outer parts.
Sorry, I'm a bit passionate when it comes to this because I find there is such a huge misconception when it comes to refurbished phones!

I understand what you are saying. My point is that it would have been nice if the guy had told me i was getting a refurbished phone, he told me i was getting a new one and the replacement refurbished phone they sent me is worse and has more problems than the one i had that was warranteed. I called the store and told them nicely what happened and the mis-information the guy told me, they told me to come in tomorrow since we have a horrendous snowstorm here in Maine and have about 10 inches of snow, we will see what happens.

The store i have been dealing with is the corporate store, they are the ones that did the first warranty...should i still just call?

they are overnighting me my new one- for free

I never knew that. My DH had a similar situation...they sent him a 2nd phone and it worked like crap and they wouldnt replace it again so he used an old cell phone we had lying around the house.

Call ...Our last phone I had 3 re furbished ones, my Dh two after original..called them and told them point blank we would NOT accept anything but a new phone....they got permission and gave us an upgrade, we were nice....
