Vacation TIme - REsigning

When you resign (give two weeks notice) - does the company legally have to pay you for the vacation time you have accrued?

No they don't. Usually when you give your notice, you forfit your right to any paid time off.

It depends on the company & how long you have been there. I have been paid for my earned vaca time in the past, but not for all jobs.

Good question.
Both times that I resigned from large companies, I got paid for my accrued time. I believe both companies had had this policy spelled out in the employee manual.

See if you can check that, if there is one........or if you keep in touch with any old co-workers!

check your employee manual, if it says you need to give 2 weeks notice so they can properly calculate your pay,including acrued pay, that means they will pay for your vacation time.

They aren't legally obligated to pay you out. However, they ARE legally obligated to fulfill what they promised you, so if it says in the employee manually that leftover vacation time will be paid out, they have to follow through. Chat Icon

both jobs I have left have paid me for vacation time

ETA- I have not been paid for personal or sick days
