"time of essance" in a contract
Did anyone have this in their contracts and did not have a problem getting it taken out???
if the 'time of essence" is still in the contract and you dont close by a certain day, they can keep your money.....

well like a mortgage contingency protects the buyers, time of the essence is looking out for the sellers. it basically gives you 30 days from the date on the contract to actually close. i think thats more than fair and if you're not comfortable and think you need more time then just ask them to change the estimated close date on the contracts.

When we purchased our home we had our lawyer put in a time of the essence clause into the contract. We, the buyer, wanted it to make sure we were in the home by a certain date. Of course we did not have another home to sell and we had a mortgage guarantee.
