Situation w/Collections...
Not me...Im done w/debt..thank gosh.
My mom cld to tell me that a collection agency called my NEIGHBOR's house (next door to us) and left a message for my brother and told them to give it to him to call them back!
Ok, 1st I have NEVER ever heard of that happening.
So, my dad called back cause he was FUMING (and my bro isnt home) and stated, You cant be calling my neighbors. So the guy got all nasty saying he can do what he wants, cursed, and said ... 'I need your son to call me" hangs up.
Ok, is this ok because I DONT THINK IT IS! I told my mom to get his name, and report his azz. Our neighbor, lucky for us is we are cool with, but there is no reason they should be getting calls for our family nor know our business.

what??? How did they even know who the neighbor was? I mean most collectors can do anything, within reason, to collect. But I've never heard of this.

No that's not allowed, they aren't even allowed to reference the debt when they leave a message on a machine...they certainly aren't allowed to call a neighbor, unless your brother listed them as a co-signer for something. Call the collection company and speak to a supervisor.

Wow I've never heard of that before...they're totally out of line on this one! First of all that's a violation of privacy I would think and second - embarrassing...no one needs to know your own personal business...report this agency ASAP.

Not only that, but they shouldn't be speaking to your father either, unless he's on the loan / credit card, whatever.
YOUR BROTHER needs to call and handle this -- AND speak to the caller's supervisor.

This has happened to my sister. They started calling my parent's even my DH's brother. They traced it because she wasn't calling them back. They never stated anything about collections though which I think is legal.

Did the message at your neighbor's say anything about debt or collections? If not, then you may not get anywhere with a complaint (though it's worth trying), as it probably isn't illegal (if they didn't mention debt / collections).
They cannot harass you (and they certainly cannot harass other people), but if it's a legitimate debt, then they do have a right to try to get in touch with you. I think calling your parents' neighbors is INSANE, though.
Has the collections agency been trying to get in touch with your brother for a long time? If your brother would just call them back and work something out with them, the calls will stop. I would really, really hope they would attempt many ways to get in touch with you before resorting to calling your neighbors... but maybe I'm wrong.
Good luck. That really is awful and embarassing. I hope it's resolved soon!

This is NOT illegal, maybe unethical, but not illegal as long as the collector only left a message and didn't tell the neighbor what exactly he was calling about.

Years ago I got a call from a collection agengy trying to contact my neighbors. My neighbors had moved about 4 months prior to this phone call. The collection agency told me the entire extent of the neighbors debt!

It is not illegal if they did not talk about debt. If the person is avoiding or not responding they do have a right to try and find you.
Which I think is a great thing.
I am not sure that is what happened in this case though.

I had no idea that that is legal. Thank god that has never happened to me because my neighbor has the biggest mouth ever

If they referanced the debt or made specific notice saying they were a collections agency, then you have a case, if not, no this is actually typical practice.
When a collector can not find you or if you avoid their calls they skip trace and come up w/ the #'s of neighbors and relatives in an attempt to gain contact w/ you. They can leave messages, but not state that they are calling from a collections dept or what you owe, but they can leave their name and phone number and ask that it be passed on for a call back. They can not give info about your account to a third party, but if your dad called them to find out why they called the neighbor or to yell at them for calling the neighbor, but they did not discuss the account in question, it is still ok.
I worked in collections for a few years. Sometimes this procedure is necessary. The company has to protect their interests and you would surprised at what some people do to avoid paying...not saying that's the case here. It's just easier to pay on time.

Im not protecting my brother in this cause obviously he is guilty of not paying someone. Just harassing my neighbors is uncalled for esp because its not their business and embarassing.
I dont know if he necessarily said who he was to my neighbor. Investigating.

Oh, no...I'm not saying you were.
I know it's a little out of the ordinary, but like I said, sometimes they do this. Definitely find out what was said.
