Question about our neighbors pool

The house behind us has a pool which is close to our property. During those heavy storms we had a few months ago a HUGE pine tree came down from back there. We have a lot of other privacy trees back there but now there is a very large gap RIGHT where the pool is. My concern now is that my boys (almost 5 and 2) can clearly see the pool and the bigger one kept asking me if he could go in it. Before it could be seen but could not have been gotten to.....now with a little effort if they really wanted to they COULD get to it. Our yards are only separated by a 3 ft chain link fence in that area.

Does anyone know the laws for pools?

I'm pretty sure they are required to have a five foot fence if they have a pool. It's probably not done legally. I'd put in a call to the town!

As the PP said, I'm pretty sure there is a law that says if you have an inground pool it needs to be fenced.

Are you sure the chain link fence is only 3' high? NYS code requires the barrier be 48" high.

Our neighbors have a pool right up against our property line, but we have a 4' chain link fence. We've actually been talking about replacing it with a 5-6' wood fence.

I thought the pool itself had to be fenced in as well if it is inground - or is that only if you don't have a fenced in property?

this is for nys even though it is on the clinton town site. Min height is 4' and if chainlink it has to be a max of 1.25" opening so little feet can't climb it.

I am pretty sure in our village any in ground pool you are required to have two fences if you have children on your property. You should have a six foot stock fence on property line with secure gates and if you have children and in ground pool then you need another fence that can be like a chain link around it. But i am very sure you need a six foot stock around your property even for home owners insurance.

Every town is different.


I needed atleast a 4 foot fence with self closing gates surrounding the pool.
I did not need a seperate (second) fence around the pool.

I'd call your town or check your town's website. They should have Pool requirements.


I wouldn't think a 3 foot chain link fence would fly in any town code.
