Pregnancy and Disability

If your doctor gives you a note to stop working early are you entitled to disability prior to delivery. This is in NYS.

At 36 weeks you can go out on disability with a note from your dr. You will get paid through the state until you have the baby and then maternity leave kicks in. If it is sooner than 36 weeks then there has to be a ligit reason why you are going out early.

Correct me if I'm wrong but once you are out at 36 weeks and lets say you are entitled to 6 weeks maternity don't they start the clock at day 1 (36 weeks) with maternity leave? For instance lets say you had your baby at 40 weeks do you now have only 2 weeks left of maternity?

it is my understanding you get 6 weeks from the date the baby is born regardless of when you went out before delivery

I read that you can only be eligible if you have worked for 4 or more weeks in the last 4 weeks.

If you wanted to go out before that I thought you could get a Dr's note and still collect.

If you qualify for FMLA you can use it before or after the baby is born, I believe, but that is unpaid.

My job is running FMLA the same time Maternity (Disablility) Leave kicks in. So lets say you have 12 weeks of FMLA that begins the same day your paid disablility kicks in.

My job also does not extend disability because of a c section. I just found this out.

I was out on STD for 23 weeks before I delivered.(FMLA ran the first 12 weeks of the leave) so technically I have no job protection. It was considered STD. I just delivered on the 6th and I officially started my Maternity leave that day and will be on maternity leave for 8 weeks due to a C section. Then I will use my vacation days and take unpaid leave.
