open house after an accepted offer
i'm really peeved because my FH and I placed an offer on a house we liked last weekend. The owners countered and we matched their counter, and our offer was accepted. We brought in an engineer on Monday (all was okay just minor stuff) and tried to proceed with the paperwork and throughout the week, our lawyer hadn't heard anything from their lawyer. Now i just found out they are having an open house this weekend!!! I feel like this is totally not fair and if they get a better offer we are out hundreds of dollars we spent for an inspection. Not to mention we lost out on another house we had an accepted offer on but decided to pursue this one. Does anyone know if theres a way we can get the homeowner to reimburse us the inspection fee if they go with another offer?? I am so frustrated at this point and most of all dissapointed because we have been searching for SO long and thought we finally had something..

im not sure but wanted to offer this is exactly why we stopped looking for a little while its to frustrating. we were told our offer was accepted...and the house was still being shown and they got an offer above listing price

i think you would have had to have them sign something beforehand to give you your inspection fee back
i can imagine how you feel - it would annoy the cr@p out of me
but - legally - they are allowed to do it - they can do anything until that contract is signed
here's to hoping you get to close easily with them & keep in mind (as much as it sucks to hear) that if its meant to be, its meant to be.

How long has the house been on the market? If it's been on for a while and this isnt the first open house I wouldnt worry too much about them getting a flurry of better offers. It happened to us too but the house had been on for 5 mos and we wound up still getting it anyway. I would light a fire under them and have the lawyer leave a message saying you want contracts done by early next week or you're walking away. That might scare them.
Unfortunately, you wont get remibursed for the inspection and they technically can do this but it stinks.

Our house had one or two open houses after our offer was accepted but before contract was signed. We did the inspection after the contract was signed with a contingency clause that we had a week or 2 to back out if we didn't like the inspection report.
I think the cost of the inspection is the risk you take if you do it before contract (which I think is actually how most people do it.) I know it stinks, but if the shoe were on the other foot, in this market, I would keep showing my house until I had a signed contract.

Our seller's had at least 2 open houses between the accepted offer and the contract. A lot of times the seller has already paid for the open house and don't want to waste the money. It's very annoying but not unusual. I was told the listing agent has to tell any interested people that there is already an accepted offer on the house.
BTW: it worked out fine for us and we're not in contract on the house.

unfortunately, until contracts are signed & downpayment given there is nothing you can do..
we had the same thing happen to us. but it worked out.
try not to worry... it will work out for you

We had the same thing happen to us. We even tortured ourselves by going to the open house. In the end everything worked out and we still got our house. Try not to stress over it too much. If they didn't get a better offer before you came along, in all likelihood they won't get one during the open house.

it totally stinks but until you are in contract there is nothing legally you can do. We got very luckly and our sellers didn't show the house once they accepted our offer, but it doesn't always happen like that.
If they are in a rush to get out, or looking for top $$ they usually do this. IMO its really wrong, but they are looking out for their best interest, and legally are allowed too. Sometimes its just the real estate pushing them

One open house we went too, they actually told us that they already accepted offers and how much they accepted! I couldn't believe it. It also turned us away bc if we put down an offer and then they did the same thing to us we couldnt do it!

personally, i'd be so pi$$ed if i took time out of my day to go look at an open house and i was told there was an offer already....it would turn me off right away, just like Heather said...
hopefully you have a lot of people like us
