NPR...but I need prayers

we just found out that my hubby is going to need surgery to repair his shoulder from car accident we had a few months back He will need to be out of work anywhere from 4-6 weeks and his job will not pay him if he doesn't work he only gets 2 sick days a year and with me pg and having all these problems they are all used up and then some he has gone a few days without pay already. I have been out of work since April b/c of pg and I am on half pay which is about $200 a week and we are barely surviving as it is my mom is already paying my truck payment...I don't know what to do I am totally beside myself this is the last thing we needed...and with a little one on the way I am afraid that we may lose our home...we bought a house to have a family we spent our entire saving on IVF to have a family and maxed out everything to live and here we are facing losing our home...he needs the surgery and the dr said he wants to schedule it in the next couple of weeks I don't know what to do. I'm just curious, is it possible to sue the 17 year old's insurance for additional money due to time and money loss with being out of work? I would think that the insurance company would be responsible for some sort of monetary negotiation because your DH now needs surgery secondary to the accident? Might be worth looking into.... Could you sue the 17 year old? Or maybe your DH could collect disability? Wouldn't the 17 year old's insurance cover pain and suffering?

I am not sure we spoke to a lawyer already but the insurance company is denying our claim because thier doc said his injury is not from the accident only the broken clavical was covered this hasn't been

you have to be out 2-3 weeks before disability kicks in and we will already be behind on the mortgage by then...

Its not optimal but you can be behind on your mortgage. You havew until the 15th to pay with no penaly and until the last day of the month with no markes on your credit. I would call the bank and explain your situation and see if they can do anything for you. Is it possible to take a small loan or cash advance on a credit card to tide you over? Have you applied for NY disability?

hmm...maybe try getting another opinion from a neuro specialist who might verify the damage that has been done was caused by the fracture to the clavical? What kind of surgery does he need?

our surgeon said that the damage is from the seat belt he had a clavical fracture that healed but left bone spurs but the surgery is going to be on his rotator cuff tear that was a result of the seat belt the dr for the insurance company says that only the fractured clavical could be from the accident itself but he did not do an MRI or anything he just said the pain he has is not from the accident and allstate dropped our claim...

that is too risky we already work pay check to paycheck and we would never catch up and as far as a loan we could not afford the payments on that right now and all our CC are maxed out from IVF we had to put alot on there to help cover whatever the insurance campany didn't we did 7 round of IVF for this little one

Wow...unbelievable. I guess no insurance company is going to just pay without a fight though. I've never been in your situation, so I certainly don't have any answers---but maybe the next step is an attorney who will file a lawsuit against the insurance company for failure to provide proper medical coverage??? Especially if there is already one doc who will attest to the fact that the damage was caused by the accident.

I know the big problem is, you have limited resources, therefore it's tough to hire the attorney to fight for you (been there on two separate occasions in the last year and a half!!), but if you can scrounge whatever pennies you do have, and borrow from whoever you possibly can....it might be worth it to find an attorney who specializes in medical insurance cases. I know I begged, borrowed, and practically stole just to survive my divorce....and I will owe quite a few people for a while, but in the end it was worth swallowing my pride because I was in a situation that was out of my control. So, if you can...that would be my only advice---to find a good lawyer who will win you some money from the insurance.

And, if all else fails....the driver is a minor. You could always sue the parents!!! That would be a last resort, but if your own surgeon is stating that the damage is secondary to the clavical fx, than you certainly have a case.

well one good thing is that my lawyer is my BIL he specializes in isurance cases as luck would have it and he will do this pro bono for us but still I hate to sue anyone it is not my style but when it comes down to it it is a dog eat dog world and I have to do what is best for me and my family...I did not just kill myself for the last 4 yrs to get here just to lose it all!!!!

NYS disability starts after 7 days but is only $34 a day. I'm so sorry you're going through this! Chat Icon

$34 A DAY WHAT AN FN JOKE
so our total take home pay between the 2 of us would be $1480 a month that doesnt even cover the mortgage well atleast I would be eligible for the WIC I was denied when I had to stop working...what a world you can pay but dont think you'll recieve anything in return

Well, I think you have your answer then....it's definitely NOT my style either, but it seems from your OP, that you're not really left with any other options. If you could seriously lose your home, then unfortunately the insurance company is forcing you to sue!!

I think what they expect is for most people to give up after they "drop the claim" because their clients either don't want to take the time to press the issue or don't have the money to get a lawyer and follow through. Or the person has enough sick time to cover the time missed....but in your case, you don't have that. So, it's not as if you're "chomping at the bits" to sue someone....you have no choice---and they put you in that situation. Thankfully, you do have a great resource available and can do it for free!!!

I would get your BIL processing that paperwork immediately and get any signed statements from the surgeon that you need....as well as copies of MRI's, XRays, and all medical reports. Be one step ahead at all times!!! The quicker you move, the better off you'll be.

thanks so much for the advise I am feeling better I felt myself getting really worked up a feared that my BP was on the rise and I am already on BP meds so I have to stay calm but I took a nice hot shower and feel better now I am sure everything is going to be OK and I know that after all we have been through my mom is not going to let us drown although I would hate for her to have to help when she has already done so much for us but I guess I could pay her back if and when we get a settlement
