New law puts points on license for texting, talking while driving

(02/08/11) WOODBURY – Officials say points could be put on your license if you are caught texting or talking while you drive.

Starting next Wednesday, officials say you will get two points if you are caught using an electronic device while driving along with a fine.

More than 5,800 people died in distracted driving crashes in 2008.

AAA says it applauds the state DMV for making the move.

I still think that there's lots of other distracting behaviors that can cause accidents...flipping through the radio dial, fumbling with the bluetooth or sunroof, eating/drinking/smoking...Anything and everything COULD be disrtacting and cause accidents, so where do we draw the line?

Yeah, this is true. But texting pretty much requires both hands and eyes while a cigarette or radio dial only or food or bluetooth only require one hand.

True...and I'm not saying this new law isn't a good idea, I just think there's other distracting behaviors too that are accepted.

I like it. One problem though...how can someone, presumably a police officer, tell if you are texting or simply holding the device in your hand or changing the song on your iPhone while you're in a moving vehicle?

It's a good law, but I think it will be difficult to enforce. I mean, it's easy enough to tell if someone is talking on the phone while driving, yet I see tons and tons of people doing it everywhere.

Changing the song on your ipod should count towards the texting rule since you are doing the same thing.

On my car, my ipod syncs to my car's radio system. I can operate the ipod from my steering wheel controls.

Yes and no. Changing a song sometimes just requires pressing one button and you don't have to even take your eyes off the road to do it. And are lawmakers savvy enough to realize this?

That's a great function, if you have a car that can do that, but obviously not every car does.

All I'm saying is that if the law specifically bans texting, how will a P.O. be able to tell if you were texting or doing one of the 15 other myriad things that a smart phone/cell phone can do?

If you are innocent you can show a copy of your phone record in court. PIA but should at least deter people.

I got a ticket recently after I had my phone on speaker on my dashboard( on a sticky mat meant for phones) and before I turned down my block to go home I turned off the phone and put it on the passenger seat. Got a ticket for texting.(officer told me they saw me texting) They must have seen me pressing the end call button on my phone. Will be fighting it.

Im sure there will be false positives but hopefully it will do more good in the long run.

Sadly I do as well. I have a friend who texts, lights and cigarette and changes the radio station all while driving and practically at the same time. She drives with her knee.

I agree unenforceable.
Define electronic device. Cell? iPod? GPS?

Also as far as I know it's legal to talk on a cell phone handsfree (which includes speakerphone).

Poorly written on News12's part.

DH and his friends who are all a bunch of bitties when it comes to BBM, have been known to text and drive at the same time. As someone who works with people who have head injury, I yell at them all the time if I observe it.

If DH got a ticket, I would applaud the cop who gave it to him.

I have seen people drive straight through stop signs because they were on their cell.

I still think many people don't realize the danger.

it's simple. don't go around holding your device in your hand. Chat Icon

the fact is, a PO won't be able to tell why you were holding your piece and not looking at the road. I say, it shouldn't matter.

but I don't drive Chat Icon so I don't know what its like to feel the need to change the song on my Ipod and be handcuffed to it for a whole 5 minutes in LI traffic!

Its been a law in Nassau for a few years, it was a $150 fine. I havent seen it enforced that much, I pass drivers all the time with cell phones talking or texting, especially on the highways

I think it's great... if anything it will have people think twice about even doing it (hopefully).

I wish they at least had the no talking on cell phone while driving law down here in FL. Every single person in their car is either talking on their phone or texting... and there are so many bad accidents down here, it's unreal.

I agree. I see people eating and driving all the time and they barely have their hands on the wheel. Not sure how that works Chat Icon

I think it isnt enforced because it isnt that easy to do, especially on a highway.
