Nervous for tomorrow
I'm having the interview at Social Security for Fred's disability claim. I am providing some paperwork and telling them his story. This is a lot of responsibility and I'm nervous and wracked with anxiety about it.
I don't have the medical records since St. Francis wants $.75 a page for the records. I feel that SS will get the records anyway from the doctors. I have provided a list of all physicians that I had come in contact with. Only 20 of them! I have his birth certificate, letter from the psychiatrists stating that I am representing him due to him not being able to represent himself. This letter is pretty powerful.
His chart was over 1600 pages when he left there. His chart at Jamaica is at 100 pages already. If I have to, I will fork over the dough and get the records, but I feel they will do it anyway.
I feel that even though Fred's case is extremely strong I will enlist the help of an attorney anyway.
Brain injury and amputation...if that's not disabled what is? I'm sure I'm in for a fight.

I have no words of wisdom for you, and I have no idea what you're in for, but I just wanted to wish you the best of luck! You've been so good to him so far, and so strong for you, your brother and everyone, you deserve this to work out for you.

And make sure you are persistent. Friends of our family were turned down for social security at first, but months later, they were approved.

I wish you a lot of luck with SS. I did all the paperwork for DH and he has approved after going for a physical through their drs. Which took about 10 months. Unfortunately, I misunderstood the letter we receive and it read that he was only approved for 1 yr.
When we went back down to SS to find out what we needed to do for him to continue to receive benefits. And explained to them that I misunderstood the letter, the exact words that came out of the reps mouth were
"don't beat yourself up over it, we sometimes write letters to confuse people"! I kid you not, this is what they told me! WTH is THAT! He suffered a traumatic brain injury, spent 6 months in the hospital, goes to therapy 6 days a week and they don't consider him to be disabled!
So we ended up hiring a lawyer to get his case reopened.
Oh, and I didn't send one piece of paper from the doctors. I listed every hospital he was at and they got all the records. So I wouldn't worry about that.
that you have no problems getting him approved.

NOPE...not sh!tting you...I wish I was. We have been fighting since Oct to get his case reopened. Just be sure to read everything very carefully and if an i isn't dotted or a t isn't crossed CALL and question it. He was also approved for the medical portion but his accident happened at work, so everything is covered under workers comp.
ETA: once he is approved he will get retroactive pay.

I'm not too familiar with the mediacl part of it. Although DH was approved in about 10 months for medicare all his medical is covered under workers comp. 24 months doesn't sound right.
Why would you be responsible for his bills?

I read if you are approved for SSD and you are under 65 you have to wait 24 months for medicare to kick in. That sounds ludicrous! I'm not saying that I am responsible personally, but the guy has to have medical help and if he can't get medicare or medicaid he's screwed. The family will have no choice but to pay. I could just pay $700/mo and keep him on Cobra once his employment is terminated.
I hope what I read about medicare is not true. I see what you mean about confusing. I will call an attorney anyway just to make sure I know the ins and outs.

I would definitely have a consult with a lawyer. Everyone told us "don't get a lawyer, you can do it all yourself, why pay someone for what you can do yourself". WELL, here we are 7 months after his SS was stopped, waiting to hear if his case will be reopened all because I misunderstood a letter. There is so much to take in, it's overwhelming. I could kick myself for not hiring a lawyer from the beginning. The only problem with hiring a lawyer is SS will no longer talk to you about YOUR case, it all has to go through your lawyer. But in the end i think it's worth it.

Especially with TBI cases I hear that it gets reviewed because there can be substantial differences once someone sustains an injury and as he/she recovers it could be much better. that blows that you are fighting. After the interview tomorrow, I'm sure my head will be spinning. I will contact someone local.

I agree it pays to contact a lawyer. My SIL was on life support & they were denying her disability. It was eventually approved retroactively but a PITA for my BIL.
Also don't pay one dime of his medical bills. Not only because it's not your debt but because if he makes payments, it means he accepts responsiblity for them. (at least this is what it meant when I worked in the legal dept of a collection agency eons ago).

Egads...why is the system like this? She was on life support and they denied her? Did they think she could get up and go to work? How ridiculous!
We haven't paid medical bills at all. We are funneling it through his insurance. Once his insurance is gone though the bils will pile up. Did your sister qualify for medicare or medicaid? I am assuming she is alive and doing ok?
