Need to Vent and need advice!!!!!!!!!
Before we closed on the house, the Seller had to fix a skylight in the bedroom from leaking. At closing he gave us a receipt that he took care of it and there was a 1 year warranty for the work. Well just got a call from my Painter that the skylight is leaking. He put a bucket under the leak so the carpet would not get wet, he said it was not a huge leak, but was defiantly water coming from it.
I called my Lawyer already and she said pretty much don't worry about it, the Seller is responsible for fixing it the correct way. She gave me the Contractor's # that was on the receipt, so I call him and what a "#@$&*$&*", he was completely being an a-hole saying "What would I like him to do" I think he did the Seller a favor and fixed it for him and now does not want to deal with it.
I left a mess. for the Seller also and waiting for him to call me back. In the end, he needs to take care of it and I am hoping he does not give me a problem. So far he has been great and he moved close to the area the house is in so he can meet the Contractor there or get it fixed the correct way.
The Contractor said he can meet me there tonight to look at it, but I really want to rip this guy a new one for being so dame rude on the phone.
Has anyone had to deal with a problem after they closed that the Seller said he was going to take care of it & it's in the contract???

The Seller just called me and he was ****** that the guy reacted that way to me. He is calling him and then calling me back, but I feel so much better that he said not to worry it will be fixed.

Id sic D on him , if u havent allready..LOL Seriouslly , there is prob some kinda 90 day warranty on the home that holds the old owner resp,,

I waited till the last minute to tell him and all I kept saying was "Don't worry I will take care of it". I caught him on a good day because we know he would be on the way to the Contractors Office already and it would not be pretty!!!

actually its more like a 3 year hold. the seller is still responsible for anything pertaining to the contract for up to 3 years. the REA are held responsible for up to 6. just a tid bit of info for anyone that needs it.

Can you elaborate, please? I've never heard of this.
Homes sold without express warranties have no implied warranties... Most items listed in the contract have to be in working order by time of closing - are you saying the sellers have responsibilities past that, even if they aren't expressly written into the contract? (Honestly would like to know...)

Then I wouldn't be calling the sellers directly. Leave it in your lawyers hands for now.
Do you think I should not even go and meet the Contractor either then? He was meeting me tonight to look at it.
