Maternity Leave Work Talk
Any advice on how to approach this?
I work for a small company and I'm the first pregnant employee they've had.
I emailed the CFO (he handles all paperwork, there is no HR) to see if we could discuss the maternity leave policy and he said to stop by his office at some point today.
I know I don't get short term disability or FMLA (since I'm here under a year).
Is there anything else I should know? I feel so clueless about this.
TIA!!!

I work for a small company (8 employees) and I don't get anything. I think if its under 50 employess and you've been there under a year you don't qualify for FMLA (not 100% sure on this though)

When you say you dont get anything, you mean the whole thing is unpaid?
I already know that I dont get FMLA, from reading about it online.

Yes, all unpaid and no legal job protection.

Re: Maternity Leave Work Talk
FMLA only applies if the company has 50 employees.
unfortunately, there is not much protection out there for smaller companies. Hopefully your boss will be nice enough to keepthe position for you.
Some options to talk about are them letting you work from home/ part time for some partor advancing vacation days from next year. Just ideas to discuss if they have no policy in place.

Re: Maternity Leave Work Talk
Thanks, I know there is no legal job protection.
I plan on asking them to eventually work from home entirely (since 4 or 5 people who do my job already do). I just don't know when to bring it up. Part of me feels like since I'm semi- new, I should wait until later. Maybe work from home part of the maternity leave and then see how that goes and ask do to it permanantly.

Re: Maternity Leave Work Talk
I was in your position when I was PG with DD. Small company (4 people) and I was the first person ever PG here. The only difference is at that time I was already with them for over 9 years. (I'm at 12 1/2 now ) I basically waited to see what my boss had to offer and was prepared to fight for more if I felt he wasn't being fair.
Luckily I got 8 weeks full pay. While I would have liked more time off I was happy to take home full pay for the time I was home.
We are going to do it the same this time around.

i work for an even smaller company, just my boss and me. i'm sure all i'll get is the what i'm pretty sure is the legal minimum of 6 weeks and i'm assuming it won't be paid. but i've been here for a few years so i can get that temp disability i guess. it's gonna make it pretty rough

Yea so I just spoke with him and they will hold my job for 6 weeks without pay. I'll only get the state mandated $170/week.
Guess I'll have to discuss the work from home option with them since thats not acceptable to me.

Legally, if the company is under 50 employees, this is all they have to offer you.
I've been with my company 5 years, and with both children, this is all I got. I was able to use vacation time to get paid during some of my leave.
Unfortunately, this is all our government requires employers to provide.

Re: Maternity Leave Work Talk
My question will be... I just started working for a company (big retail).. I'm going to be under the 1year mark when the baby arrives.. so do I qualify for fmla? Or at least 6 weeks paid. I want to know ahead of time before I start asking questions.

Re: Maternity Leave Work Talk
If your company has 50+ employees they have to hold your job for 12 weeks per FMLA. BUT... they have no obligation to pay you at all for any of those weeks. That part is entirely up to your company. I am the first pregnant woman at my company also, and while I do qualify for FMLA, they are still trying to "create" a policy as far as how many weeks they will pay me for. I think they're leaning toward paying a week for every year of employment (which for me would be 5 weeks). After that, I will use any vacation/sick time I have saved up and then the remaining weeks will be unpaid.

You don't qualify for FMLA since you've been there under a year. They aren't required to hold your job at all. And it's up to the company whether its paid or unpaid.

I don't care for the job.. its just something to get me throught these next few months while I'm in school. I should be able to get more information since I'm. An HR Assistant. Now digging I will be in this system today.

Re: Maternity Leave Work Talk
Do doctors render you disabled for only 6 weeks? What is the likelihood that they could extend that diability time? What is the threshold? Does anyone know?

Re: Maternity Leave Work Talk
it increases to 8 for a c section but if you develop a hernia or something it can be extended.
