Maternity leave

i know its been asked a million times, but where do i find what is the "law". My office is very laid back and 99% men. When i last asked one of the higher ups i was told "umm, i don't, this has never happened before". Today my boss told me to bring him something that says "something about it"

Kind of iffy right now, since i'm probably going to be switching firms. There won't be many at the new place, but my boss will probably go along with the policy for a big firm.

I don't think there is any requirements for maternity leave other than under NYS disability which is 6 weeks unpaid leave for a vaginal birth & 8 weeks unpaid for c-section. Disability will pay you 170.00 per week (before taxes) after the 8th day of the disability. If you are employed by a firm for at least one year and they have at least 50 employees, you are covered under the FMLA which allows for up to 12 weeks unpaid leave without jeopardizing your position with the company.

IF you are less than 50 employess they are not reqired to give you any but if you are more than 50 than they have to let you have 12 weeks off and guarantee your position or another when you come back
They don't have to pay you for it though.

My friend is a benefits manager.
If over 50 employees, NYS has to give you 6 weeks paid maternity for a natural delivery and 8 for a c/s.
You can opt and the co. can allow you to take up to 12 weeks, but the next 6 weeks after the first 6 is at a much lower pay rate.
The co. also only has to hold A position for you, they don't have to hold your position.
**This happened to someone I know- they worked in sales and came back from maternity leave and they stuck her in accounting. She didn't know anything about accounting!

They can't take away your salary though, just demote you or put you in a different dept.

I'll find out from her if there is a benefits website-

My company applies their disability policy to maternity leave. I get 6 weeks vaginal or 8 weeks c-section at 100% salary. After that we go on unpaid leave up to 12 weeks.

I don't think there is a requirement by NYS to be paid when you are on maternity leave - only the disability rate which is 170.00 per week. No employer, regardless of how many employees is mandated to pay your salary while out on leave. The 50 employees is only for the FMLA.

Here is what I found on the NYS website:

Disability benefits are only paid when you are disabled. Benefits do not include time off for family illness, injury or adoption.

The benefit rate is 50% of the employee’s average gross wages for the last eight weeks up to a maximum benefit of $170 per week. Claimants must be out of work eight (8) consecutive days to be eligible for benefits. The first week (seven days) is an unpaid waiting period. The maximum benefit is payable up to 26 weeks in a 52-week period.

Pregnancy related disabilities are paid the same as any other disability claim. Generally, a claimant is covered six (6) weeks after a normal delivery and eight (8) weeks after a Caesarian section (the first week is a non-paid waiting week). Time off from work requires medical documentation by the medical provider. The disability may be extended before or after pregnancy if there are complications.


Medical documentation for the disability must be provided for all periods you are requesting payment. Benefit checks are processed every two weeks.
