Married Dependent Deduction??
If your 21 year old daughter got married and in is in College. She is living with her parents due to her husband being deployed and because she can't afford just yet to move to be with him when he gets back home to his base. She wants to file jointly with her husband so she can use that money to move to Alaska to be with him when he comes home. Her parents gave her $500 dollars for school this year and according to her knew she wouldn't be able to pay it back now they are flipping out because they don't want her to file jointly so she can be their dependent.
Is that possible?

If she files jointly... the mother wont be able to claim her as a dependant. There is nothing she can really do about it.
If the daughter checks the box that nobody can claim her as a depandent... and the mother says she is claiming the daughter as a dependent... the IRS may come knocking on somebody's door (probably the mother).

She knows that, but was hoping that their was some reason why her mom couldn't make her a dependent since she is married. I was wondering if their is a test or something. I couldn't really find much. Basically her mom is being a PITA. The daughter and Son in law are planning on using the return so she can move herself up to Alaska and use it for deposits and stuff. Her parents want to do house renovations and are guilting her because they want to write her off for the extra deductions. I think its bull. It was 500 and the mother knew she wasen't getting it back. Her daughter wants to file joint with her husband so she can move and live with him...

The Mother needs to get a grip. The daughter is married now. Isn't it time to "let go"?
But they should also work out all the senarios. Sometimes a married couple will get more tax savings by filing separately comapred to jointly.

Her husband and her will get about 2500 back if they file jointly. But her Mom is just being a PITA. So she is pretty much looking for a way to be like, "hey Mom you can't claim me as a dependent' without causing WWIII in her house. They have a good relationship her parents just never thought they wouldn't have her as a deduction and they were banking on their return as well. For not as good of a reason IMO but still so she is trying to not rock the boat too much.

Its simple. She says she is filing jointly because she is now MARRIED. End of story.
If she has any questions about how this may impact her taxes... tell her to speak to her local CPA.

I'm sure I"m misreading this post.
This woman is living with her parents and can't afford to move out even though she is married. But the Mother is being a pain in the *** for wanting to claim someone who was completely dependent on them for food and shelter as a dependent?
I believe it's up to the individual to decide how to file not the parent. IMO, she's got some nerve.

The military does not pay for you to move your wife or husband to your location. The husband was lower enlisted and living in a dorm like setting prior to the deployment and getting married when he gets back they have the expense of moving her and their stuff to Alaska, moving his stuff out of the dorm...etc. They do have some of it saved up but she was hoping to get up their prior to him getting home and getting to ball started with the refund. Their orginal plan was for her to use a small amount she had saved but since she was about 12 credits away from her BSN her Mother told her she could stay with them, pay rent.. etc and could stay her to attend school and save up. Rather then get in some debt and put back her graduation another year or so because she would try to find another school and loose credits. I never said that she was completely dependent on her Mother at all. Basically all the Mother has done is Gift her $500 bucks so she would stay in school and knew her daughter wouldn't be paying her back. The daughter pays her own way. I was just hoping that maybe someone might have some wisdom for her according to any tests for proving dependency or lack their of?

I think once you are married you have to file married joint or separate, but I still do not think that you can be claimed as a dependent once you are married. I would call up H&R Block and just ask them that question on the phone, I do not think they would charge you.

That is how I thought it was and was just wondering if anyone knew for sure after hours last night. But I guess not. I'll just tell her to call H&R block. thanks
