I just had a HUGE disagreement with our comptroller over NYS disability leave for pregancy. She told me that the 6 weeks is two before delivery and 4 after <period>. I told her that made no sense to be b/c babies come on their own schedule and asked what happens if I take 2 weeks before and baby doesn't come for 3. Her answer - I don't get paid for the one week!! Then she says it's not her it is NYS law and I should just look it up. So I did! (note to comptroller - do not tell a lawyer in this office to look up the law b/c we will)

OMG!!! The law she is talking about was repealed in 1981!!!! Chat Icon Chat Icon

There are like 10 different women that have worked for this agency since 1981 that have been screwed out of 2 weeks disability payments b/c of this!!!! Chat Icon Chat Icon

And to top it all off, she is still insisting she is correct - even though my immediate supervisor told her she was wrong. I just know that my OB is going to have to jump through hoops filling out the disability forms to get me the damn 6 weeks!!!!

ETA:
I called NYS while she was out to lunch. I told my supervisor I didn't want to get into an argument with the comptroller, but NYS said I was right and that 6 weeks is customary for after vaginal delivery. She said, no need to get into an argument, the comptroller has nothing to do with it - it's the insurance company! If that is the case why was the comptroller arguing with me to begin with??? well...o am foreced to use sick days beofre i can se disability and it only pays 170 a week...haha i have 6 weeks sick pay saved so if i have a ce setion ill get anothher 170 for 2 weeks...wooooooooooopppppppie

What a stupid b1tch. Does she not comprehend that YOU are LAWYER, which job (I'm assuming here) entails understanding the law! I would have HR speak to her if she gives you any more problems . . . or can you report her to anyone? People like her make me mad!

First of all...why does it matter to her when you take your weeks. You are entitled to take your disability whenever you want. I'm taking mine as soon as the baby is born. I don't want to waste days before hand, and you shouldn't have to either.

I had called the labor board about the same exact question.. and they told me disability is allowed 6 weeks for regular childbirth and if its a c-section its 8 weeks... and also if you take three months maternitiy leave and you work for a company with less than 50 employees they don't have to take you back by law....Chat Icon Chat Icon Chat Icon Chat Icon

People will try to get away with anything. This happens especially within pregnancy and childbirth. I wont even go into the crap you ( and many of us dealt with during PG. Need I remind you of my boss telling me to sit sideways to reach my controls) Why somebody thought they could get by you is beyond me. You are all on it!! Chat Icon Chat Icon

Unfortunately, our jobs are just the beginning. Not sure if you saw the recent post on Parenting that many have gotten billed because a doctor (out of network) was assigned to many of us. And we've received thousands of dollars in bills. They expect us to not fight and go with the flow. Little did they know who they were dealing with! Chat Icon
