Liability question...
Hi! I have a question... I had a leak last Sunday from my boiler. It was pretty bad in the dining room of my condo. I cleaned it with two carpet cleaners and put fans out and it is now perfect. The water went through to my neighbor's condo. I didn't tell her because I assumed that since it was a firewall, it would not leak through. When she told me that she had water in her place I offered to come and help her clean her condo and she said no, her brother was there with a vacuum cleaning it. Anyway, she just put a note on my door that it's still week (almost a week later) and is beginning to smell and she wants her carpet replace. Am I responsible for that?

If the water did, indeed, come from your condo and caused damage, she is entitled to compensation. However, there are a few things you need to find out. First, did YOU, actually, cause the damage. You need to see pictures or, if possible, get a first-hand look as to where the water came from. Second, how damaged is the carpet? Can it be cleaned or does it, actually, need to be replaced? Did she call someone to come in and give an assessment of the damage? She needs to provide you with proof. Third, how old is the carpet? She is only entitled to the value of the carpet at the time of the damage. In other words, if the carpet is 10 years old, she is not entitled to brand new carpet, but, instead to a fraction of what she paid. She needs to provide you with receipts as to when she bought the carpet, where she bought the carpet and how much she spent. People think they should get far more than they are, actually, entitled to. Just out of curiosity, doesn't she have insurance? In any case, be careful. Approach this with caution. Good luck.

Thank you so much. Before I pay for anything, I am going to offer to go over with my carpet cleaner and clean it for her. Since it worked on mine (which must have been a lot more water than hers), it should work on hers. I will ask her about insurance (I do not have insurance). And I will pay for it to get professionally cleaned, definitely not replaced.
