Landlord and problems question?
I know we're in NC so maybe the law's different, but does anyone know anything about problems with Landlords, leases and moving out?
We have been having problems with our landlord since before we moved in. Of course everything was wonderful before then when we signed a lease. We signed a 3 yr lease. (personal reasons). But anyway we have months of emails back and forth of him not doing what he was suppose to do prior to move in and most of it is still not done. We are so tired of asking him to do them. We have only been there since 8/1/09. On 8/24/09 he replied to an email we sent that if we're not happy he would give us some time and that we could leave. Of course we said no we didn't want to leave, we just want you to do what you said you were going to do. We always wanted to leave but we paid $1,500 to have the back area fenced in so we felt we were stuck. It has been a nightmare since we moved in. One big thing is that he was suppose to have his refrigerator, and washer and dryer moved out prior to move-in. Let's just say that they're there still in the garage which we're paying for but yet can't park in there. And we actually had to move the appliances ourselves when we moved in because he didn't. So many problems, that this isn't the only one. We have emails backing us up regarding all of these issues, him saying we can leave if we're not happy, he claims he can get more money anyway for the place, it took him 2 months to fix the stove, sink is still not fixed, etc. So many issues we've just had enough and want to leave 3/1/10. We haven't said anything yet, but we want to tell him we are not happy, we are paying rent for a garage we can't use, nothing gets taken care of, place was and still is filthy since we moved in, etc. We are going to live out our security for February and that is it. I am going to mention that we have all the emails about what he hasn't done and of him saying we can leave. Is there any chance that he would take us to court about this and could actually win or do you think we'll be ok? He knows he's wrong. He's a cheap man who says it's just a rental, he doesn't care basically. What are your thoughts? We might be getting another place right around the corner from where we are but don't want any problems with him. He might just say fine since he's I'm sure he's sick of us, but then I don't know? WDYT?

It's kind of weird that he keeps telling you that you can leave if you want to, but by not fixing anything, he is kind of forcing you out.

I would write out a list of what he hasn't done
then put the date you are moving out
and ask him to sign it
notarzie it and release you from the lease
in the future I would not sign a 3 year lease-
