Just found out there I have no job protection while I am out on "maternity leave"
I work for Countrywide Home Loans, a big company that makes a lot of money and they do not even offer job protection for those going out on what they call disability for employees who do not have FMLA. I cannot believe we do not have better laws protecting women who have babies. This is unbelievable to me! Luckily I had intentions of not coming back to work, but what about those who rely on their job and their salary. This is so sad. I originally thought I had job security for those 6 weeks, now I just confirmed with HR that I do not. This company sucks!

that's unbelievable!
When my mom had me and my sister (in 1973 and 1977) her insurance didnt cover vaginal deliveries. She and my dad had to pay for everything!
I'm amazed at the progress we've made in some areas - and how far we still have to go in others! No job protection? yikes

How long have you been there?
Our policy is the same. If you are not covered by FMLA because you haven't hit your minimum requirements yet, then you are not job protected.

Our policy is the same. If you are not covered by FMLA because you haven't hit your minimum requirements yet, then you are not job protected.
Same here, but they usually will hold your job for at least 12 weeks if you have a good record....

FMLA requires that you work a certain number of hours in the past year, I believe 1250 and that the company has 50 or more employees to qualify for FMLA. If you/your company fall under these guidelines, they HAVE to offer FMLA to their employees which will offer the employee up to 12 weeks of UNPAID time.

I have only been working here for 8 mo., 10 mo. when the baby is due. I thought you had job security even if it was only disability and not through FMLA, apparently we don't. If the company feels they need to fill your position, they can lay you off or fire you.

Ahhh, well if you don't qualify, you don't qualify unfortunately. I thought you meant they don't offer FMLA at all.
Technically my company doesn't have to keep my job for me, since we have way less than 50 employees (Law Office). I don't think they realize that though since they include the whole FMLA thing in our handbook and tell everyone that we get 12 weeks off for maternity leave.
