Hypothetical question
If someone gets hurt at your house, say a kid falls on your swingset or whatever and the people want compensation can it go through your homeowners insurance? We recently bought a new bigger playset and dh was talking about this when we had a few kids over.

Hypothetical question
I guess? Honestly, if that’s a huge concern I’d find my kids new friends. Unless a kid’s parents were blatantly negligent I couldn’t imagine demanding compensation because my kid got a boo boo on a swing set.

Hypothetical question
I would assume yes considering insurance companies are so concerned about things like pools and trampolines.

Hypothetical question
Yes it will. I know of a situation like that of real life best friends, and needless to say, it completely changed their friendship. After 20+ years now, it's kind of behind them.

Re: Hypothetical question
I can't imagine asking for compensation if DD got hurt at someone's house. I mean, I have health insurance- they will cover it. Health insurance is not like car insurance where if you make a claim, your rates go up.
Are people looking to make cash on it? Compensation for pain and suffering?

Yes, they would have to file a claim with your homeowner's insurance.

Yes, they would have to file a claim with your homeowner's insurance.
This is exactly correct. Your insurance company would represent you (provide an attorney to represent you) if you are sued in that type of situation. But, many homeowners policies have exclusions for a trampoline so just be aware of that

Hypothetical question
My neighbor (and former friend) slipped on a step in my backyard and is suing me. It can happen. Our homeowners insurance company is representing us.

My question is- and I know people do this all the time (sue when they get hurt)- but, was it your fault? Was the step icy because you didn't clear it? Was it in disrepair? Did they slip on a loose brick or stone you should have fixed?
Or were they just a klutz and hurt themselves on your property through no fault of yours and now they want what from you?
Their medical bills paid? Did they have medical insurance?
Or to get rich off of an unfortunate accident?
I hate how litigious this country has become.

Re: Hypothetical question
Just another side to this
Many people like me are in high deductible insurance plans. If god forbid something happened and we had an ER visit or surgery, I’d be out 10k. This is with insurance.
I’m not saying I would sue over this, but some faced with this situation would.
There may be a perception your insurance company would pay, not you.
A little different but a family member is suing FIL over a car accident for pain and suffering

Hypothetical question
Unless someone was grossly negligent I cannot imagine suing or asking for compensation if my child got hurt playing at a friend's house.

Hypothetical question
Idk I mean I get having high cost plans, but you knowly engage in an activity, when it comes to kids, I would say parents need to be attending to their child, however if there was a loose screw, or broken pieces, you fail to fix, I could see that. Even with high deductible plans, if you get hurt anywhere doing anything, are you going to sue just to have it covered? No, you knowly and willing engage in activities, unless there is a situation that could cause injury unless rectified, I think it’s ridiculous, my niece fell in my house, because my BIL and SIL were not watching her after I repeatedly told them they need to tell her she cannot go up and down my stairs without supervision (she’s little) guess what they let her run through my house after us telling them multiple times to watch her, she fell down a flight of stairs at my house, BIL immediately said, hope you have good home insurance and I flipped, she made a huge hole in the wall and 13 people witnesssd her behavior and saw she was not being watched, and I have gates to baby proof she kept hopping over by my stairs. She made a hole in the wall and it became a fight we made them fix it because this wouldn’t have happened if they were watching their child and not negligent parents (multiple incidents with my niece over the year) and even had 2 CPS calls. So they ended up not suing because of the evidence and their open CPS case... you never know with people

There was nothing wrong with the step. Broad daylight, 4th of July BBQ. We think it’s not our fault, and so does our insurance company, which is why they won’t settle, and we may have to go to court for a trial.
They have loads of money. Their three cars include an Infiniti, a Range Rover and a Maserati. They have medical insurance.

Re: Hypothetical question
Thanks for the replies. Unfortunately I don't trust anyone. I recently watched a very close family member break up our family over money (inheritance). I personally would never sue over anything, this is how I think now of other people.

This is what the lawyers will hash out - but there are plenty of people that will try to sue for any little thing, figuring that insurance companies will eventually settle, even if it's for a relatively small amount
