HR Q regarding resigning and FMLA
I am on FMLA for maternity leave.
If I want to resign from my job, do I HAVE TO go back to work on my return date then resign and give 2 weeks notice or can I resign while on FMLA 2 weeks prior to my return date?

You can resign while on FMLA.
All FMLA is doing is keeping your job open for you.
So technically you can resign after your Short Term Disability has run out since that's what's paying you.
But I would wait until the end of the FMLA anyway - just in case something were to happen where you wanted/neeed your job back.
When the week that you are planning to return comes up, just call them and say you aren't planning to return.
However, you will legally owe them any money for benefits continuation if you had that.
