How much can your rent be raised???

Well things fell through with the house we were buying.....after waiting months to close.......all of these unknown things came up with the house so we decided to walk away from the deal.....so it looks like we will be in our apt for a little longer. We have been renting for the past 3 years from my grandfather who was only charging us $600 a month....but now that he has passed away my greedy aunts want to raise our rent to $1200......so I was just wondering if that is legal.....can you raise someones rent by double? I can see raising it a few hundred...but double??? Some people are just so spiteful......and when I move out I am going to take great pleasure in taking all the light fixtures with me.....along with ripping up all the carpets and taking them too since we put them in.

They think it disgusting but they always get overruled because it is two against one.....supposidly they are having a discussion on this sunday and my parent s are going to try for it to be only $800 but I doubt they'll go for it! Ehhh...I just pray we find a house soon!

Bye the way steph.....your little guy looked so cute in his little pumpkin outfit...He is so cute!

Yikes! Is it a legal apartment? If not, i know there is a city agency you can report it to, so that it comes back to bite them. Chat Icon i'll look for the links when I get to work.

Based on your story, it seems that it is a private house. If that is the case, they can raise it to whatever they want, especially if $1200 would be closer to market value (which it seems like it probably would).

The rent stabilization act A) only affects NYC and B) only affects specifically designated rent stabilized buildings. While most NYC rental buildings are a part of this, some are not. Neither are private houses, nor subleasing (as in a co-op or just a sublease on a rental).

I'm sorry you have to deal with this but legally, it seems like it's all on the up and up.


ETS: if my assumptions about it being a private house and living outside of NYC are incorrect, the maximum amount your rent can be raised (under the same tenant) is 4.5% on a 1 year lease and 7.5% on a two year lease. When you move, the maximum they can raise it for the next tenant is 20%.

Its a legal 3 family house in Queens....We never had a lease and all though it is legal we have always paid cash so they haven't been claiming it.....so technically they can get in trouble can't they?

While they can't get in trouble for raising the rent, yes, they can get in trouble for the tax issues...

I would consult a lawyer who specializes in tenant-landlord law, b/c it sounds like it will get really complicated.

I believe they can raise your rent as much as they want.

The only way you are entitled to rent stabilization is if you are in a licenced rent stabalized building. And then they can only raise by a certain percentage.

And if you report them... what is that going to solve? You think the relations are bad now? LOL

Your best bet is to either pay... or just move out.

I believe that unless it is rent controlled or rent stabilized- they can do whatever they want..

But that's bullshite that it's family-- especially when they can charge someone else higher once you move out- which you are looking to do anyway.
