Holy idiot Landlords
Dh and I live in the upstairs of a house, nobody lives downstairs. DH just went down there to go out back and noticed a box on the table, inside the box was one of those plastic lock boxes to put over the thermostat.
OK, now anyone who lives or ever lived in the upstairs of a house knows how cold it can get up there in the winter. Our only ways of adjusting heat are downstairs and they have always left that open to us. It is freezing up here in the winter and we usually have to put the heat at almost 83 in winter just for it to be semi warm and now they are going to set it and lock it on us!! I don't think so. Can they even do that??? The insulation in this house stinks, old windows, old siding so of course its gonna be cold. Dh tried to tell these people to put in a seperate heating system up here, with our own thermostat, slap on new siding and they'll save some money in the long run, but they are so dumb and CHEAP, they don't plan on doing it.
Anyway..Can they do this?? Can they legally set the heat down there at say 75, when it actuality it is only 60 up here in mid winter??

Can we come live with you?? This house is very old..never ever been worked on or updated. We have one radiator in each room and half the time they do not work. Then they'll come two months later to fix them and then in a matter of weeks they are out again. This house needs serious updating. We're looking to get out of here, but not finding much that we like yet!!

Hmm...I THINK there's some sort of law about landlords and temperatures, but I'm not positive. Maybe you should try discussing it with them?

I don't think you legally need to be able to access the thermostat but in NYC the landlord must provide heat as follows:
By law, residential owners must provide adequate heat between October 1 and May 31. During this period, between 6:00 a.m. and 10:00 p.m., if the outside temperature is below 55 degrees Fahrenheit, owners must heat apartments to at least 68 degrees Fahrenheit. Between 10:00 p.m. and 6:00 a.m., if the outside temperature is below 40 degrees Fahrenheit, owners must heat apartments to at least 55 degrees Fahrenheit. Owners must also provide hot water at a minimum constant temperature of 120 degrees Fahrenheit all year round.

Thanks!! Our landlords live in New Jersey, so there is no way they are going to come every time we need the heat raised, thats what is making us mad. They live in NJ and we aren't going to have access to the heat and be screwed!!

Then they should keep the heat set for a minimum of 68 degrees all day long. Good luck...I had a crazy cheap @ss landlord once and was never so cold until I got over my concerns with using the oven for heat (it was a studio and they paid for the gas )
