NYS law is that if the ring was given on valentines day, her birthday or Christmas
she does not have to return the ring to the man no matter who did the breaking up or for what reason. Any other date the ring belongs to the man.

Sorry I was just talking to the guy he gave her the ring on july 14 no special occasion.. but she said her lawyer says it is her's but i didn't think that was true !

That is what I was looking for
I'd also like to add that it depends on state law, but an engagement ring is considered a conditional gift given in contemplation of marriage. When the marriage contract does not occur, the conditions of the gift have not been met and the ring should be returned.
