Foreclosure
I'm a regular poster but have to post under a fake name. My DH and I were both laid off from our jobs. We were recently issued a foreclosure summons. We have missed a few payments but have tried to pay as much as we can even though we don't have jobs. We have already applied for a loan modification. We have also borrowed money from both of our families to help pay what we owe. We have to file an answer with the court and the attorney for the mortgage company. So, I guess my question is, has this ever happened to anyone and does anyone know the best format to write our answer? I know who to answer to and what needs to be said, I'm just not sure of the formatting. Is there anywhere online I could see an example? We have called several attorneys and we cannot afford one. TY! FM if you'd like...

Re: Foreclosure
I'm sorry you are going through this.
I can't help with the letter writing but just wanted to say that lots of the info I've heard or seen on TV finance shows that the foreclosure process is actually taking a long time due to so many people doing loan modifications and refinancing, etc. I guess I'm just trying to say that hopefully you'll have some time to get things worked out.

Re: Foreclosure

Have you tried contacting Legal Aid to see if you qualify for a attorney?
I'm not sure if you live in NY, I found this reference online from South Brooklyn Legal Services. They provide legal services to low income individuals. On their site they have a document called How to Answer a Foreclosure Complaint Pro Se These docs might give you some guidance, but I definitely recommend trying to find an attorney who will work with you.
Good Luck

Re: Foreclosure
I do not know of any but I just want you to know how sorry I am. I am living paycheck to paycheck and what you are going through is my worst fear. I will pray for you even though it probably can't help now but I will do it anyway. Good Luck

I have no advice for you either, I am so sorry you and your dh are going through this difficult time, I pray things get better for you, and I hope you both find or get called back to work. but I agree try calling legal aide. I hope things turn around so you can keep your home.
