For those using the same real estate agent as buyer/seller
something has come up and the person we are working with has a listing of a house we would not have originally considered but now we are.
How does this work? She was out to help the seller first. how can she possibly not use the info she knows about me to help the seller? and how can she not use the info she has on him to benefit me?
Is this a bad idea?
I was reading online on NYS website that to go into this she must have in writing from both of us, an acceptance letter, that we both are aware that she is dual representation. If you used the same agent did they do this?
Or should I just call my real estate attorney before putting in an offer and discuss everything with him?? help, I feel so lost!

She represents the seller no matter what, unless you sign her as a buyers broker.
The house we re buying is the exact same situation, she is the listing agent. I called to see the house and liked her so I kept using her. But in the end her listing was the one we liked the most. Give your atty a call, they may be able to give you better clarity, but in this case it wasn't a problem.

she is suppose to have you sign a disclosure saying you know she is the sellers agent
and techincally- she should have someone else in the office handle your side
it's a sticky situation- she obligated to be loyal to the seller first

did you sign your lady on to be a buyers broker? And your sale went through without any problems doing this?

did you sign your lady on to be a buyers broker? And your sale went through without any problems doing this?
We were thinking about signing her, but ended up just keeping things the way they were. It was a bit easier becausse the was one less person to have to go through with the bidding back and forth. We haven't closed yet (lawyer issue) and everything has been very smooth with her.

Agreed- the agents on both side of the transaction always represent the seller- thats who pays them- its really not a big deal to have her do both sides of the transaction- sometimes they will ask someone from the office to represent the buyer- but its really not necessary
