? for girls who went out on early disability
I got a call from my HR rep today to confirm my return date. She is telling me that my Maternity leave (protected leave through FLMA) began the first day I stayed home for my prescribed bed rest. I was under the impression that those 4 weeks were covered under regular NYS short-term disability. So now I have to return to work when the baby is 8 weeks in stead of 12?
Any help appreciated.

That is what I was told too..that my Disability cut into my FMLA time ( sorry )
I ended up not qualifying for FMLA, only NYS disability..and it ends July 15th, so I have to go back to work ( if I decide to) within like 5 weeks of delivery, even c section if I want to hold onto my job.

Aw, its alright. I am trying to see if my job will allow me to use the daycare for that extra 4 weeks before they close out daycare center in Sept....

That's right. Any medical leave does fall under FMLA.

Yes. That's the main problem with bed rest and not coming back to work before labor.
They count your time on bed rest out of the 12 weeks of FMLA.

My company had told me that if you go out early then FMLA starts to run and if you are out of that time than your return date would then be 6 weeks after vaginal or 8 weeks after csection for return per STD. Not sure if that is standard but that is how my company works.

I just talked to my HR person about this yesterday. I dont know if its the company's policy or if its FMLA, but if i were to go on bedrest prior to the birth of my baby it is not time deducted from the 12 weeks i get after birth.

Ive been out of the loop for awhile now but Ive done company benefits in the past...
Basically what there is is THE LAW and then there is company policy....from my understanding is that any company, with more than 50 employees, needs to comply with the FMLA which is 12 weeks...
I believe that 12 weeks is for any type of sickness related issue...
for example
my DH could stay home after the baby is born, albeit without pay, and he'd still have a job to return to....His job does not give him maternity leave. My neighbor across the street, could do the same thing. BUT his job gave him 2 days maternity leave when the new baby was born with pay...that was his "company policy" and had nothing to do with FMLA...My daughters teacher stayed home for the remainder of the school year, after her daughter was born and could of stayed out a year,without pay...that was how the teaching contract was written.
Some companies give added incentives regarding job security due to the birth of a new baby or illness while others only comply with what is legally necessary...

Yes.
You can "trick" the system if you go on STD for just a couple of weeks and come back to work, then leave again when you have the baby. Although some company can "force" you to take the FMLA.
FMLA is purely voluntary. It's just a protection so your job is safe while on STD.
