Wondering if anyone has knowledge on this, My company was bought out by a bigger company in June, we all do the same job just changed names, now I was told by HR i do not qualify for FMLA because they are considering my start date to be when the new company took over....do you think there is a loop hole for this, it doesnt seem right to me?????

Does your company provide short term disability or do you pay each pay check for disability. You may be able to get paid leave that way.

FMLA is only effective if you worked for the company for 12 months and worked 1250 hours during those 12 months. If your previous company was bought out it seems that they are right although I think it is completely unfair. Maybe they are willing to work with you.

I will be able to use short term dis but must return after 6 weeks vag birth or 8 weeks section

That does seem really unfair. If you have a new start date does that also mean that you can't get into the 401K or health insurance until the initial grace period is up?

It doesn't seem like they could declare you as a new hire in one case and not the other. I'm sorry I don't have an answer for you, maybe there is some kind of labor advocate you could contact?

That actually seems like complete BS and would honestly try to fight with HR regarding this, bc that just seems shady....

I totally agree! There's got to be a way around it, it's not fair to you

Did your previous company have at least 50 employees within a 75 mile radius? If not, the company did not fall under FMLA.

No the waived that and we got into medical and 401 K right away and lost no vaca time

Were you informed of this change in your seniority date prior to you request for disability? If not I would think you'd have amo for a good fight. I'm afraid it is quite possible that what they are telling you is true though. That's awful!
