Dh and I decided that once this Chat Icon is born, that i would stop working and stay home to take care of her. At least until she is old enough where we would feel comfortable leaving her with someone to watch her.

I had already told my boss about setting me up when the time comes for disability (i only get the min 6 weeks through NYS)

I have not yet told my job that I will not be returning after she is born.

Does anyone know if you still qualify for disability if you will not be returning to work afterwards?

I don't think they would give you disability if you told them upfront that you don't plan on coming back. I could be wrong but this is what happened to a woman that worked here. She went out on maternity leave, got paid her disability (6 weeks) and then toward the end of her leave (I don't know if she planned on taking an additional 6 weeks unpaid) she told our boss she was not coming back.

I agree with PP i *think* you need to wait until AFTER your disability is almost up before you put in notice.

I mean why would they be 'obligated' to pay if you have no plans on coming back? Telling them ahead is like putting in your notice but planning not to work through the end of the notice period.

I'd wait.

I can't not tell my job that I'm not coming back since we;re a small company (less than 10 employees) and I have been with the company for 10 years. I would feel bad not telling them I would not be returning and I wouldn't want to burn any bridges, KWIM?
My job doesn't offer FMLA - so I don't have the option of taking 12 weeks, and after the first paid 6 weeks maternity leave, telling them I would not be returning.

I would do the numbers....

I don't think it's worth it. My workplace still remembers someone from over 10 years ago who collected pay and didn't come back. It was disability equivalent for 6 weeks only. They saw this as screwing them over.

If you can do without... And you may need a recommendation later, be upfront.

Honestly disability is SO little money...if you have a good relationship with your job and don't want to burn bridges, I would forfeit the disability to give them the respect of advanced notice.
Disability is through the state though, correct? So since you're technically unable to work any job for those 6 weeks you may still qualify.

i was told that disability was through my job, although i thought it was through the state as well.
I was told that disability was about $170 a week. peanuts really, but would help with formula/diapers

what is your company's policy? i know for me, i was able to get disability at half pay which i supplemented with 1/2 vacation time for 6 weeks, so i technically got paid my full salary for those 6 weeks. i agree with a PP though, calculate the numbers and if you are not getting much then maybe its just worth it to tell them in advance.

You cannot collect disability if you are not working. So if you tell them you are not coming back then the last day of work before the baby is you r last day of work. You cannot then collect disabilty because you would not be disabled from your job since you do not then have a job.

there is no policy. i feel like my boss just makes this stuff up as he goes along. no policy book, nothing. so if i ask him it would tip him off that i am not coming back.

If you're not working for them, they don't owe you disability.

yeah thats what I was getting at. But I see where youre coming from. Prehaps you can talk to him? But to be fair to him, they'll be paying for you.
