Closing date/move in date
I have a quick question that I am sure some of you could answer for me. We were given a tentative closing date for June 27th and were told that the house would be in our possession on July 1st. Is that allowed without us approving it? We have to be out of our apartment by June 30th. Also, do the buyers have any say in the time of the closing?

Absolutely. The buyers def. have a say in the closing date. What was your tenative date in the contract and sadly did you agree (ie sign) to it?

That would have been in your contract as it was in ours. Luckily, we are getting the keys and they are not staying but we knew that they wanted to.

Well we had an on or about June 1st closing date, but we knew we wanted to close at the end of the month. I am a teacher and my son is at a babysitter up here in Westchester and I didn't want to take him out before the end of the school year, so the end of the month works great for us, I just want to be able to close and get possession. The buyer was great though, we put the offer in in February and he has waited all this time for us.

Usually in every contract the sellers have 3 to 7 days after a closing to get out of the house....usually in the rider section. At closing an escrow agreement will be drawn up and the seller's attorney will hold escrow until you get possession. Usually it is agreed that the sellers will pay the taxes and your mortgage interest for the days that they stay in the house but this is usually something worked out prior to closing. Most peopel will agree to let people stay in a house 2-3 days after closing as it is very hard these days with banks to sell adn then buy a house in teh same day and it is typical that people don't hand over the keys at the table. It happened to us at our closing. We closed on a Wednesday and took possession on Saturday. If our seller's stayed in the house past Sat at 5pm they would have had to pay us $250 a day until they got out. good luck
