The law firm will have to account for the "unitemized legal expenses" but it is conceivable that they spent $2579 on experts and other expenses. The lien is probably for money that the person has already received through other means, such as Workers' Compensation. The law firm will have to answer to this but fault also lies in the horrendous Workers' Comp. system that we have in New York. In addition, there are bills pending that will make the Workers' Comp. system worse for injured workers. This person is likely entitled to additional benefits under other settlement programs, such as the Zadroga Act. In fact, those programs might have required him to follow through with this case even if he knew that he would not net any money. It's not fair by any means at all but nothing is as simple as a short article in The Post. The red tape is ridiculous.

This is what I suspected

It's not that I am saying that this person does not deserve money directly from Merill Lynch but The Post just does not tell a full story about any legal matters. The man has settled his Workers' Comp. case for cash and he will be entitled to additional monies. This is sort of like the McDonald's case where the media never told a full story.

In this case it looks like he accepted the 10,000 offer before it became known he had cancer. In this regard if the case was already settled and the papers signed then the case was over. If the case had been still live through the time of... the discovery of the cancer, the pleading known as the bill of particulars could have been amended.

The case with the initial complaints of chronic rhinosinusitis and sleep disorders had a limited recovery. However, there should not have been a net zero recovery to the client.
