Can a preschool with a toddler program open with no heat?

I got a call from the director of my DD's 2 year old program last night. She said they were opening with no power or heat and its up to me if I want to send her. Of course I am not sending her but I was wondering if this is some kind of code violation? Does anyone know?

My power is still out and I tried to search the Internet with my phone but its not easy.

b) Areas that will be used by the children must be well-lighted and well-ventilated. Heating, ventilation and lighting equipment must be adequate for the protection of the health of the children. A temperature of at least 68 degrees Fahrenheit must be maintained in all rooms to be occupied by children.

They can technically do what they want if its just a program and not a licensed daycare. Unfortunately they don't fall under the same regulations. Personally I don't think they should be opening under those conditions.

I think it depends on if it is a daycare/preschool program or an enrichment program.

IE, Mommy and me, seperation classes, etc that are short and do not have the requirements of a preschool/daycare.

My 2 year old DD takes some classes where we are not required to give immunizations records etc, and those are considered enrichment programs that are i believe do not have to follow the state rules.

I probably wouldn't send my child either, but it depends on how bright the area is, how long it is, and what the inside temp is.

I'd love to know that too... last year after Irene ds old daycare opened when they didn't have power - it was up to people if they wanted to send their kids - the rooms were very dark since windows were only at the very top of the wall.

Thank you. I probably wouldn't care if it was warm but my house is freezing. I can't imagine what he school feels like.

I agree. I think it's in poor judgement to open.
