Are we liable for anything here??

DH and I needed a window replaced in the babies room asap. We had a guy coming for an estimate and a friend recommended some guy working on his house at the time, so we said to send him over for an estimate. When the friends guy cam over he gave a good price and we told him to see if he could get the window and call us the next day. He took my DH's cell and our house phone and we never heard from him. Meanwhile the other guy came to check it out and gave us the same price and was willing to sign contracts to make everything official, so we signed, since we never hear back from the other guy and he DID NOT leave us his number, so we had no way of contacting him. DH tol his friend if he saw the guy, to tell him we had three days for him to call back, before the contract with the other guy was set in stone. He never called back. Well, tonight DH gets a message that the window is in and he can put it in whenever we want. Well, we don't want it. We never really hired this guy, he was supposed to call back the next day to tell us if he could get it and now two weeks later he decides to call and tell us he has it, it is a custom window. Are we wrong here?? We had no way to get in touch with him and he never called us like he was supposed to, so we went with the reliable person. Are we liable to this guy?? DH is going to call him on Monday and tell him we went with someone else, he never called us back, we figured he didn't want the job. Thanks...sorry so long!!

I would think that since you never signed a contract with this guy and he promised to call and never did, then you aren't liable. I hope everything works out.
