Anyone work for the town?

So we are in the process of buying a house. Of course it's perfect and I knew it was too good to be true. The problem (bear with me it gets confusing) the sellers pay $40 a month to lease half their backyard to the town. Not exactly sure why, but the town owns half their backyard for whatever reason. We just found this out yesterday. My DH feels like he wants to back out if he finds out that at any point if the town wants that land back they can take half our backyard. My question is, what is the likelyhood that this can happen? Is it possible that they can do this? We both love this house very much and the only way DH will go through with the process is if the town can gaurentee they will not want to take our property. Anyone have any insights?

well technically, it's not your property if the town owns it and you have to lease it. how big would the backyard be if you cut out the leased part? if it were me i would either take the house and not lease that part of the property or walk away.

The house is in Bohemia and our attorney is looking into it, we probably won't hear from her until Mon. I'm just hoping there is a glimmer of hope we can follow through with the plans to purchase this house. I'm not exactly sure how much is the towns property, I'm thinking our attorney will find out the details for us.

If it's only a few feet, maybe I'd be okay with it. Assume that the town will take that partof the yard back at some point. Will you be okay with what's left? Also, what is behind the property? If it's a busy street and they'd take the land to expand it, then I'd walk away.
