wow, I'm so surprised that this never came up with your attorney before or at closing. its either 2 family or not. And I know for our mortgage app it needed to know 2 family or 1 and they wanted to see the title etc as proof. so odd that no one ever told you!
I don't have any advice other then my parents bought a 2 family house and took the stove out. had the town come and inspect, and they were re-assessed as a 1 family. all it takes is the stove.

wow so for all these years your DH might have been paying for a 2 family when it never was one. That sux! I'm sure you will figure it out and if you took out the kitchen it shouldn't be considered a rental of any kind. Obviously they have to call it something, but not a 2 family. Can't wait to hear the update on this one. Good Luck!
I know when we bought our Hi-Ranch, there was already an apartment on the 1st floor. But we knew that we had to go and get the permit from the Village (which we did). Without the permit we could not have the kitchen down there. So if we didn't want to have the apartment we would have to take out the entire kitchen, everything (cabinets, stove, frig) and seal up any holes in the walls. I believe we can also get a permit for a Summer Kitchen I believe they call it, but it's not for an apartment. Weird how some of these towns work. So that is my experience in the Town of Babylon, Village of Lindenhurst. GL!
