any lawyers on here? or those who have gone to small claims
I"m going on Friday and have a few questions..
we are taking the guy we hired to install a fence in our yard to court...he basically took our deposit and ran...
(my DH did not listen to me and decided to give him a dp without even starting work)
So this is my question...we have the signed contract from him stating he was going to do work...copy of our check that he cashed...what else do I need to bring to court?
Am i missing anything?

I am not an attorney but I used to be a mediator at Small Claims in Nassau. The judge will most likely have the parties participate in Mediation onsite first before going back the judge.
What type of Case? Which Court?

no advice, just some good luck dust 
I was going to ask you about this!
I would think any proof you have that he was supposed to do the work.
maybe take pics of your backyard (with the date on them) so you can show that the fence was never installed?

i would get a disposable camera and have the pics printed so it shows the date on the back, and bring the recepit in showing you just bought the camera.

if he shows up or not, he is screwed..
all the times he said he was coming to give us our refund he never showed so we will see if shows this time
oh yeah another question...I want to report him to the BBB...but what if his buisness is a phony? can i do it just under his name

I'm an attorney.
I would bring *any* evidence of the negotiations between the two of you- letters, phone messages, etc... If you had someone else do the work that he was supposed to do, I would also bring any evidence of that (including a bill).
I would bring any photos you have and date them
