Teachers - Maternity Leave Question?
How does maternity leave work in your district? Also, if you take any unpaid leave, do you lose seniority?

My school has a great sick policy for maternity leave....we have unlimited sick time. So when you're out, you're out, as long as you have a doctor's note. And we have up to 2 years after the birth of the baby (unpaid) that we can take off without losing our position. I feel like it would be illegal for you to lose seniority because of maternity leave....but I would check with your union rep.

8 weeks c-section paid
all unpaid leave you lose seniority.... hence why I am now lowest on the toad em pole

I'm in a private school. We use all our sick days/personal days first, then go on disability. 8 wks for CS, 6 weeks for regular

BOCES- No paid leave. At all.
We can use all of our saved up sick time and come back when it's done. Seniority still accrues, in this case.
Or you can take un-paid leave. In this case you may only come back on Sept 1st or Feb. 1st and you do not accrue senoirity during the unpaid time.
So you don't lose seniority but, people can pass you.. Kind of like it freezes while you are out and then when you come back you start to acrrue it again.

It definitely depends on the district.
In my district you have to use your sick days. You can use up to 6 weeks for a vaginal birth and 8 weeks of sick days for a csection. You can take up to 12 weeks through FMLA but the last 4-6 weeks (depending on the type of birth) are unpaid but you still have your benefits.
If you take unpaid leave abover and beyond the 12 weeks of FMLA then you lose seniority.

Same here. But I am not sure about the seniority part.

Same with my district. I used 6 weeks of sick days and then took six weeks unpaid. My salary changes are now mid October because I lost six weeks and if there was anyone that close to me on the seniority list i would have gone down.

I think most NY school districts are the same-- 6 weeks paid - vbirth 8 weeks paid- csec -- all from sick days. You can take 12 weeks w/o losing seniority, but anything beyond the 6 or 8 is unpaid. You are allowed 2 years max at a time before losing your job completely.

We have the option of taking up to 2 years of unpaid leave per child as well but every district doesn't have that. And in our district you are guaranteed a job not necessarily the job you left. They can transfer you to a different grade level or school within your tenure area.

This is what I thought, but unfortunately in my district you start losing seniority as soon as you go off payroll - I am LIVID. With all the nonsense that has been going on, I cannot chance any loss in seniority

In my district, if you do an unpaid leave it affects seniority. Right now I am using sick days (per my doctor's request). I am going back to work sometime in April. Originally, I was going to do the Family Medical Leave and stay out until Sept, but that would have been unpaid. I would have been in danger of getting excessed.
