What are your thoughts on this???
OK, so our neighbors have a tree that is on their property, but a huge part of it hangs over our property. In the sprint or summer it drops berries all over the place. On our driveway, on our cars, we step on them and they end up in the house.
Do you think it is wrong to go over to them and ask if we could have the part that hangs over our property taken down? At our expense?
We are getting our driveway redone in a couple of weeks, we don't want to have the paint on the cars ruined, and we got tired last year of having berries constantly squished on the bottom of all our shoes.
Just looking for opinions on this situation. I'm not one for taking down trees, but this tree is a nuisance to our property and cars. Thoughts??? TIA!!

I don't think there is a problem with asking, but you have to be prepared for the consequences if they say no.
Will you still be okay with them?
Will things be awkward?

Or if they say no can you think of another type of tree that you might be willing to pay for and offer to replace it with that?
But as the pp said be prepared for them to say no.

To be honest with you, they live behind us and we really don't know them that well. We have been in the house for a year and have only met them once.
We are not looking to take the whole tree down, just the large branch that hangs over our property. And to tell you the truth, the part of their backyard that the tree is in is at the corner of their property where it is all overgrown with bushes and other small trees. I can't see how they would miss it.
But you bring up a good point, to be prepared for them to say no. Although there must be some kind of rule somewhere about property that is a nuisance to your neighbor's property.

Doesn't hurt to mention it. My brother had a problem with his neighbors tree and he went over to discuss it. Turns out the neighbor hated the tree too, so they had a tree trimming party in July. Worked out great for both parties. I am always the one to say it doesn't hurt to ask!

Doesn't hurt to talk to them.
I have the same problem with our neighbors tree.
One day I saw them outside and let them know I was going to prune it up a little, since we were having issues with the berries on our driveway and cars. They didn't have an issue with it at all.
Since than, every once in awhile I see the husband out there pruning the branches.
Good Luck, hopefully they will be understanding. I'm sure if it was their driveway they wouldn't want berries staining it or landing on their cars either. Maybe they don't even realize the problem/issue.

If their tree is hanging over on your property---the part that is over your property ----you have the right to cut back/trim. We have a neighbor behind us that has a tree that hangs over our fence---we trim it ourselves every summer so the leaves do not go into our pool--we never asked for permission.

You are right, they probably don't notice the berry issue because on their property the berries just land in the bushes area in the corner of their property. The tree is really just in the corner of their yard that is all overgrown. Ugh, I hope they don't have a problem with it.

I wish it were that easy. We would actually have to get a tree service to take down a huge branch that is way high up. We can't even reach the branches to simply prune it. That is why I am now worried that they may not agree to it and we will have to live with berries on our cars and all over our driveway. Ugh!!!

In most jurisdictions, if the tree hangs over you property line, its yours, you can prune, cut, remove do what ever you want to it, up to the plain of your property line.---it came from this source
Call your city hall and ask to speak to the city attorney. Ask him what the ordinance is ragarding this situation. If you don't live in the city, call your county courthouse and ask for the county commissioner. Usually if it hangs on your side of the property line, you can cut it, but is it worth going to court and having hard feeling with your neighbors?----it came from this source
If the roots or branches of your neighbor’s tree encroach on your land, you can cut them back to the boundary line. If you do not want to do this yourself, you can ask a district court for an order for the trimming or even removal of the tree.---here is the souce to this

either way, I think you should be courteous and ask. A friend of mine just recently asked there neighbor and had no problems. But, like everyone else mentioned, be prepared for no.
