I dont know the actual legal answer, but if something just happened to you and not your DH and your DH has full custody of your children, then it is your DH's choice to who he brings his children in contact with...

Well, any will can be "secret". Usually only the attorney and the person whose will it is have a copy. If you are worried about it being secret from your in laws, that shouldn't be issue. I don't know if you could have it secret from your DH though. You may have conflicting wills and that could lead to a big mess.

If you die and he has legal custody and wants the kids to see his parents or have them babysit, I don't think your will saying you don't want them to see the grandparents would "trump" his wishes.

i am not a lawyer but i work in the family court system and i do know that if you pass away before your husband, he has custody of them, and gets to make the childrearing decisions, so if you wrote a letter, had it notorized, and gave it to your mom, he could very easily fight that in court. is there any way you could discuss this with him? this should really be in your joint will too if it means that much to you.
