The sellers are unbelievable......(Updated)

WE went over to the house on Saturday to look at some furniture they wanted to leave and we noticed that they took out the antique bathtub from the bathroom. The had one of those really expensive tubs with the claw feet......well its gone and in its place was what looked like to me .....and old tub with white caulking all over the place.....I guess trying to repair the mess they made.....So now we are waiting to hear back from our lawyer.....but that was definitely not in the contract....Now I wonder what other sneaky things they are trying to do!

Update....Ok we just got a call back from our lawyer who said the sellers have no idea what we are talking about....UMMMM hello....its not a towel bar you took down....I think I would know if you took out the tub. So what now?

Unless otherwise stated all fixtures, appliances, and even window treatments are suppposed to come with the house.

My lawyer asked me that when we called them to sell our house. She said they would have to be in the contract if we were taking anything with us. I laughed when she said window treatments. I've since taken my really good treatments down in the bedrooom and just put up white curtains but I'm showing the house that way.

The people who are selling us their home are taking their window treatments and certain light fixtures... They are all custom curtains that match their furniture and their light fixtures were antiques, clearly stated in the contract.
The tub thing is weird!

That is just too weird.....who the hell takes their bathtub? Well I bet they sold it....when I did a search online it was worth $4000. But still it wasn't in the contract.....maybe I wouldn't be so mad if they put a new tub in the bathroom and did it the right way. WEll I'll keep you posted!

Wow thats a bunch of BS!!! They should not being doing that - it could be a deal breaker - if its not in the contract they cant do it!!

Good luck - and when you do your final walk through you better notice everything.

Maybe you can get a credit (cash) at closing for the tub? Get an estimated appraisal and tell them you want that amount at closing!

I completely agree with Kathy. However, I wasn't aware the the sellers' had to leave all that stuff. I thought they were allowed to take it. I learned me "new" thing today.

Yes, if you haven't already called your lawyer call them now!!! This is a problem. Can you think of anything else they might take. Schedule your walk-through earlier than the day before so if there are any problems.

BTW: A guy I work with bought his first house 27 years ago. The day they were moving in he dropped his wife off and went back to get more stuff. He found her one hour later crying on the front porch... the selller had taken ALL OF THE LIGHT BULBS!!! Of course this is before the days of 24 Hour Home Depots. People never cease to amaze me!Chat Icon

Oh yeah they are not allowed to take anything out of the house (not even a light fixture) unless its in the contract - and certainly NOT the bathtub!! Chat Icon Chat Icon Chat Icon

That stinks and happened to us...BUT the previous owners of our house stayed a few days after closing and had to leave $$ in escrow...we had a couple days after they left in which we could check the house and let our lawyer know when to release the money. Thank goodness we did, because they took all the toilet paper holders, towel racks, and they even took the front doorknob...one of those long handled fancy ones and replaced it with a regular round cheap one and SPACKLED the hole where the end of the handle fit in. People are TRULY unbelievable!

We did however make sure that our lawyer wrote in the contract that the stainless steel appliances were included because we were told that if you weren't specific then the homeowner could replace the appliances with cheap ones any color they wanted.

OMG- when my dad sold his house we were told you cannot remove ANY appliances or fixtures- from the lawyer- we werent planning on it anyway but I remember him saying that- cause I was shocked thinking isnt that part of the "house"- why would he say such a thing- I see why now- I hope you get PAYED on that!!!!!!

Did you take pics of the house when you did the inspection or looked at the house? Any pics of the bathroom? I took pics of EVERYTHING.

If you think they are lying to you I dont know how to prove it - you could BLUFF and just SAY that you have pictures of the original tub??
