I was told today that it does not need to be reported to both insurance companies just to the person who was at fault.

I was hit from behind, I didn't call my company yet, took the car in for an estimate. I was told we can go though the other person insurance only and mine doesn't have to be involved unless the other company does not cooperate.

I had the police come, it was not major but the kid, 20 yr old was texting while driving and hit me.

I always thought both companies must be called. any one know or hear different??

I got hit from behind. Driver took full responsibility. We only went through HIS insurance. I did NOT call mine at all.

Okay. Thank you. It's about $1000 worth of damage. Im not sure which way this kid will go. I was so pissed about being hit again and by someone texting

He offered me money at the scene.

Thanks everyone. I realized the officer really only asked where the accident happened and not for details. I told him the driver was texting. The kid confessed it to me and said he was sorry, going but denied it the officer. I saw him looking down the entire time he was behind me. He was on top of me the entire time and I was worried he would ram me and did, we were in a turning lane. Not sure how the officer can write a report without asking more questions. These are things you think of after the fact. I could not stop shaking after. My last accident was 6/2015 and my car was crushed in a 4 car accident. The only car unable to be moved without a flat bed, everyone else was able to drive away, I went to the hosptial.

Im ok physically, but not emotionally. I think I'll call the precinct tomorrow.

My DH got involved in a fender bender. A guy was pulling out of a spot in a parking lot and hit my DH's bumper because he didn't see him. DH called our insurance company and they said to contact his insurance company if he was at fault. So that is what DH did. He got an estimate from the body shop and sent it to the other guy's insurance. The other guy's insurance also covered a rental car while Dh's car was getting fixed. The key here is the other guy admitted fault so there may be a problem if the person involved in your accident isn't admitting fault. Then it would go through both.

The police file the report, but the insurance company(s) will interview you both.

IF he takes full responsibility, that's one thing. But he can change his tune once he talks to his parents or the insurance company. Then your two insurance companies decide who was at fault and the percentage. Since you were rear-ended, it's most likely going to be found in your favor, but it could even go 80-20. Basically, you need to protect yourself and report it. I think you usually have 10 days or something around there to report it.

Your insurance company works for you. His insurance company is going to try their hardest to not pay and drag it out.

I got into an accident in the summer, went thru my insurance even though he was at fault and my car had 10K worth of damage fixed and car returned to me in 1 week. No muss no fuss. Then my insurance company dealt with them and got the money back.

Meanwhile, his insurance company sent me a form 3 weeks later so they could investigate the accident. If I went thru his side alone, I'm sure it would have dragged out for months.

If they find its not your fault, there is no reason not to go thru your company. If its not your fault then you most likely wont be put on your insurance record as an accident.

I was hit from behind twice in the past year. I was 100% not at fault for either accident.

For the first one, i reported it to my insurance but they told me unless I wanted to put the claim through them, i did not need to report it.
For the next one, it went solely through the driver whose fault it was. The officer who took the report told me the same thing (i only needed to report it if I wanted to go through my insurance) but she also said if I wanted a copy of the police report for free, my insurance co could get it for me. Otherwise, if i went to get it myself, i would have to pay for a copy

so I called this kid on Monday to discuss how he wants to proceed. He answers his phone while driving. I can hear the traffic and he told me, he asked if he can call me back since he was driving.... still waiting for him to call

worst part, he did learn a lesson. !!!
