FMLA... how does it work?

i've never had to take time off from work for any reason that would qualify under FMLA.

now, it looks like i'm going to need surgery and won't be able to drive/work for a little bit of time.

i'll be going through the information my employer has, but my main question at this point of the process is... what if i ask for X number of days and my recovery goes slower than expected. can i ask for more days?

You will need to provide documentation in order for them to extend to show proof that you need the time off such as a lettr from your dr.

just a little scared of the surgery and wanted to know that if the doctor feels i need a little more time, it will be available.

If the surgery is for yourself this is probably more disability then FMLA

Yes. If you employer has Short term disability you can be covered under that.
There is also state disabillity but it doesn't pay great

FMLA doesn't pay you- it just guarantees your job will be there when you get back but it's generally for caring for a family member, having a baby etc

If your recovery is going longer than expected I am sure your doctor can send documentation to extend whatever leave you are on.

looks like i have a bit of reading to do.

yes, the surgery is for me.
i'm finally moving forward with fixing my eyes. one dr already said that i'll need surgery to remove the cataract. got the initial appt with the surgeon, tomorrow.

from what i've read, recovery is an average of about a week... but that's for the "usual" cataract that comes from old age. mine is slightly different and not sure if recovery is the same.

since i'm at the end of my day and tomorrow is my appt. i'll just wait until wednesday and reach out to HR to discuss my options.

FMLA only applies for companies with more than 50 employees, not sure that applies for your job.

FMLA... how does it work?

For FMLA it covers yourself, a spouse, child or parent. I would absolutely apply for FMLA to protect your job while you are out. You can take FMLA in conjunction with disability. You can apply for both they are completely different. FMLA will not pay you to be out, most employers require you to use your sick time first then may allow you to use your vacation time to get paid. Some employers make you use all of your paid time off before the disability payments will even kick in.

If you need to extend your leave most employers will ask you for a doctors note explaining how much time is needed. I would also have the doctor indicate if you will need intermittent leave for after you return for any follow up visits.

before you take FMLA does your job offer short and long term disability ?

I would find out before you go taking unpaid leave.

your doctor would have to file papers to extend your leave.

yeah, i'm on the other coast.

the company i work for definitely has more than 50 employees. i'm in the middle of composing an email to my local HR person, plus i see the surgeon today.

you guys have given me a lot of good information to start with.

The maximum number of days you can take is 60 days in a rolling 12-month period. Basically, FMLA holds your job while you're out.

Ny does not have "paid fmla"

it's different/ separate

~FMLA protects your job (50+ employees if you've worked there over a year)- UNPAID

can overlap with these for pay:
~disability pay - your own medical issue
~PFL pay - family member

But i am confused because on my maternity leave (this is disability right?) now they are saying i have to use PFL...
what if i wanted to do both? OR save PFL for something else. its so confusing!

in CA, it's very similar. FMLA will guarantee that my job will be there when i get back, EDD is what will pay me for my time off.

yes but technically you cannot go back until you are medically cleared which occurs at 6 weeks.
