Return from maternity leave ?
I returned to work last week after 12 weeks of fmla. I want to quit but our handbook stated that I have to return to work for 30 days or I will have to pay back health insurance premiums that the company paid out while I was on fmla. Does anyone know if this is 30 calendar days or 30 working days? Can I give notice prior to completing the 30 days? I'm afraid to contact hr to get specifics

Unfortunately, you need to question HR to be specific but I would think it would be 30 calendar days. How does your job react when someone gives 2 weeks notice? Are they walked out the door right then and there or can you stay for the two weeks?

There's always a chance you could be asked to leave immediately when you give notice. So, I'd wait.

They need the help so I doubt they would have me leave. Someone else from my team quit 3 weeks ago and was able to finish the 2 weeks.

I would ask and get it in writing if you want to get out ASAP. What's the worst they can do? Terminate your employment? If they do that they can't require you to pay back health benefits.

Except they weren't in your position where you're just returning from 12 weeks out. In your case, I wouldn't give your notice until you've been back a month.

Actually I dont think that is true. My friends company took all the health insurance pay back from his last check. He eventually sued them and won but it was a big pia!

I would think 30 calendar days but I'd probably wait to give notice after 30 working days just in case. Too bad you can't ask HR. Can you stick it out?
