Any lawyers or those familiar with Wills?

Are there any lawyers out there that can tell me if this sounds right? my husband and I are going away together, without the kids and we don’t have a will. Through my works life insurance policy that they offer, they offer a free Will that you make yourself (you state your choices and it inputs it for you) into the will.

If I want my spouse to basically get everything and IF he dies, then I want my kids to get everything equally... what do I pick?

do I pick that my spouse gets everything and then my kids are the successor Residuary Beneficiaries? Also do I want a trust to be formed if it all goes to the kids/minors?

that's my 1st question.

I was told that if you have young kids to make whoever you have as the person who would care for your kids the life insurance beneficiaries. My sister is listed as the person I would like to care for my kids if anything were to happen to me AND my DH - so she is listed as the the residuary beneficiary. My DH is listed as the first one - this is just in case we BOTH have something happen to us.

you want to make sure whoever is caring for your kids have the financial means to do so.

My lawyer had me create trusts for my kids with the person who would care for them as trustee. The trustee can access the money until whatever age you designate for them to take control over it.

here are some of the titles/options I chose:

-assets should be used to pay any estate expenses: all of your assets
-do you wish to apportion expenses: yes
-tangible personal property: all to your spouse
-any special provisions for your spouse: all real estate
- cash bequests: all to your spouse
-Do you want to name your children as equal successor beneficiaries: yes
-intangible personal property: all to your spouse
-cancellation of debt: yes cancel all debts
-residuary estate: all to one beneficiary (my spouse)
-successor Residuary Beneficiaries: listed my 3 boys
-transfers to dependents: separate trusts only
-trusts: small portion of earnings to beneficiary: no until 18
-trustees of trusts: we put the same person as the one listed as the guardian of the kids
-executor: my spouse, second executor: guardian of our kids
-survivorship: 30 days


does this all sound about right???

I just want to make sure everything is in place before we go, leaving them behind.
