Asking for a friend...she was out of work for almost 3 months due to medical leave
For thirteen years she ha worked the same shift. She finds out today that when she goes back her hours are changed to the night shift (which she cannot work).

Yes, it just happened in my office. I believe they have to keep your exact job for 3 months. After that, all bets are off. She was out for 5 months and they changed her hours just by one hour though- not to an entirely different shift.

yes. They only need to hold a similar job. You are not guaranteed your expect position.

It's actually been 10 weeks not 3 months does that make a difference?

In my office I think it does... but I have no idea if it varies or if it's a set policy.

They only have to hold a similar job not the exact one. So doing the same position just a different shift would be ok

And if the person cannot work the new shift what happens? They just quit? Or get laid off?

They only have to hold a similar position. Hours don't matter. It also doesn't matter the length if it was FMLA.

They'd have to quit.
The company won't lay them off and pay unemployment etc....

This happened to me. I worked the day shift at a newspaper for almost 4 years. The weekly papers I worked on went under so they switched me to the night desk of the dailies. I attempted to get another day time position within my company but didn't get it. I spoke to HR and told them I wanted to collect unemployment because they changed my terms of hire. They said I still had the same position and that I wouldn't be able to collect. I decided to quit, but I went ahead and filed for unemployment anyway. My job tried to fight it, but after not showing up for two trial dates it was dismissed and I collected unemployment. Now this was about 11 years ago, so I'm not sure what has/has not changed since then.

It's really such a shame, she has a day job for personal reasons, had to take a medical leave and now ready to go back to work to find out her shift is gone to someone that has only been there for 9 months
Sucky situation to say the least

This is terrible to hear. I'm sorry for your friend. I'm in an industry that is changing and evolving and when I leave for maternity next week...I worry if my position will still be here when I return. If my position is eliminated they do give me a period of time to search within the company for something else once I return...does your friend maybe have that option at least?
